RESOLUTION 220 <br />Maintenance Agreement No. <br />RTA1E OF MINNESOTA <br />DEPARTMENT OF HIGHWAYS <br />AGREEMENT FOR REIMBURSING MINNESOTA HIGHWAY DEPARTMENT FOR LABOR AND EQUIPMENT <br />FURNISHED DURING THE CIVIL DEFENSE EMERGENCY RESULTING FROM STORM @F MAY 6, 1965. <br />THIS AGREEMENT made and entered into by and between the State of Minnesota <br />acting through the Commissioner of Highways, hereinafter referred to as the "State <br />and the Village of Mounds View <br />hereinafter referred to as the <br />"Municipality Witneeseth: <br />Pursuant to Sections 12.37 and 160.21 Minnesota Statutes annotated, repre- <br />s,ntatives of the aforesaid Municipality requested the Minnesota Highway Department <br />to furnish labor and equipment, as required, to remove debris from any and all <br />roads and highways (other than Trunk Highways) under the jurisdiction of the <br />hunicipality and to otherwise restore and maintain said roads and highways in a <br />passable condition after the storm of May 6, 1965. <br />The State will furnish said labor and equipment for storm clean up work <br />on said roads and highways as so requested, provided, however, that said men and <br />equipment shall only be furnished by the State hereunder in the event that in the <br />opinion and judgement of the Area Maintenance Engineer, whose decision shall be <br />final, said men and equipment are available therefor without impeding or affecting <br />the need and use of the same on the State Trunk Highway system. <br />The Municipality agrees to reimburse the Trunk Highway Fund for the cost <br />of furnishing said labor and equipment in the manner and extent hereinafter set <br />forth: <br />1. The State will prepare and submit to the Municipality an itemized <br />statement showing total labor and equipment used in said storm <br />clean up work on and after May 6, 1965, until the official of said <br />Municipality, in charge of said roads and highways, advises the Area <br />Maintenance Engineer of the Department of Highways at his office at <br />2055 Lilac Drive North Minnesota, that the State's assistance in <br />Golden Valley, Minnesota- 1 <br />
