THIRD RIDER TO AGREEMENT THIS AGREEMENT, i;ade tnis 29th day of Juiy 1968, by and between the BOARD OF WATER COMMISSIONERS of the City of Saint Paul, hereinafter call.:_ the "Board," and the VILLAGE OF MOUNDS VIEW, COUNTY OF kAmser, :4INNkSOTA, hereinafter called the "Village," being a Third Rider to that certain Agreement made by and betweee said Board and..said Village: the 27th 4..so October, 1965, and by this reference incor- porated herein add made part and parcel hereof with the same intent, purpose and effect .a if said Agreement were set forte herein, verbatim. WITMESSET WHEREAS, The Hoard now possesses title to an easement in certain real estate bring generally north Of and adjacent to County Road I, in Section 6, Township 30, Range 23, in Ramsay County, said real estate being hereinafter called "Premises and, WHEREAS, The Village desires permission to enter upon certain porticos of said Premises and to thereon construct and maintain s public road; and, WHEREAS, The Board is willing to grant said permission to the Villegc &intent with the requirement and safety of the works of the Board, NOW, THEREF08E, BE IT AGREED, In consideration of the mutual promises and Lr' agreements of the parties hereto: That subject to ell the terms and conditions contained in said Agreement between the parties hereto made end entered into the 27th dey of October, 1965, the Hoard hereby grants to the Village the right to construct and maintain n public road described as follows! A 30 -feet wide roadway over and across those portions of the Hoard's Mississippi River Conduit* rights -of -way between the extended westerly and easterly property lines of Knollwood Drive in Haugen's Addition, Ramsay County. Roadway and concrete slab required over the conduits will be located and built as shown on Plan Sheet 6 of 11, Job No. 3116, dated May 9, 196d, as prepared by Comstock Mi Davin, Inc., Coosulttag Engineers for the Village of Mounds Vies. Said plan by this reference is insorpormted herein the sit as if set forth herein verbatim.
