000125 <br />-3- <br />August 28th Council Meeting (con't) <br />Mr. Skiba gave a report regarding a spot check of some of the <br />homes in the Village, suspected of using Tillage water. without a <br />meter.' A: one home it was quite obvious that water had been hastily <br />disc onneced, moments before the inspection. Another home w as <br />definetly hooked up to the Village water system and was using water <br />without a meter, in direct violation of the ordinance. Skiba asked <br />the Council how they would like to handle this matter. <br />Mr. Blanchard stated that in his opinion there should be no <br />doubt, about what_ course _to follow as the law was broken and that <br />it was,poesible that another 20 or more people could be using the <br />water iii then same manner, and `he further stated that in his opinion <br />prosecution was the only course to take when dealing with a theif. <br />Some of the other Council members felt that prosecution was not <br />necesea <br />Sect 9n ,z3of Ordinance #74 was read by the Attorney aid discussed <br />at some length by Council members. <br />Motion by Mayor Crane that the people admitting using Village <br />water without a meter or those where there is evidence of using water <br />without a,meter be required to pay an amount to be determined by the <br />Village Clerk and the Water Superintendent, based on the normal use <br />from April 1, 19611 Seconded by Christensen. 4 Ayes. <br />Mr. James Cr. Schlichtman, President of the Mounds View Businessman <br />Association read a letter to the members of the Village Council and <br />presented the Village with a copy(on file) regarding their first <br />social ebent and extending an invitation to all to attend. <br />The meeting was recessed for ten minutes. Called to order at 10:55. <br />The Engineer reported on the easement for Fairchild Ave. for., water <br />Project 1961 -1. He stated that two residents refused to grant the <br />easement required of 15 ft. <br />Mr. Geo. Porter /980 Fairahild that he- would•'allawa maximum o <br />12.7 feet without condemnation providing the Village would,guarentee <br />in writing to replace area as it was before water line installed. <br />Several questions were raised regarding the need of the easement <br />and the Engineer pointed out that 15 feet was the least the Village <br />could go. <br />Mr. Fred Rudulph, 8084 Fairchild Ave., stated that he could not <br />sign for an easement without reimbursement as this would cue down his <br />lot size to such an amount that he would only be able to subdivide <br />into two lots instead of three he would get at the present time. <br />Mr. Christensen stated that he felt the area would have to be <br />dropped from the project as it would be a minimum of 30 days after <br />condemnation before we could begin laying the water line and this <br />would hold up the project. <br />The Mayor informed those present that the entire post of condemnation <br />could be assessed against the one street if the Council so desired. <br />Motion by Blanchard to delete the Fairchild Ave. portion of t:ie <br />1961 -1 I later Project from the project and issue a change order on same. <br />Seconded by Christensen. <br />Mr. Ted Quien, 8045 Fairchild Ave. stated that he felt this <br />would not be fair to those on this street who had petitioned for water. <br />Upon call of the roll. 5 Ayes for approval. <br />
