Mayor Neisen's Report 2 Mayor Neisen read a report from the Police Chief stating that there had been 265 junked or unlicensed vehicles tagged in the Village. Clerk- Administrator Zylla's Report MSP (Pickar /Baumgartner) To approve the following licenses: General Contractor D. L. Scherer, David R. Mueller; Cement Contractor Leo Huot; Rooting Contractor DeRayco Contractor; Heating Contractor Swenson Heating Air Conditioning and Garbage /Rubbish Hauler Guy's Disposal, Rubbish Removal Inc, Kersten Truck Service, All -State Disposal Service, Inc., Ace Colid Waste Management Inc., and Peterson Bros. Sanitation, Inc. 4 Ayes Johnson Naye MSP (Pickar /Hodges) To approve a transient merchant license fcr Donald Rudkin, 8150 Eastwood Road, to sell watermelons on the corner of Eastwood Road and Highway #10, subject to the stipulation that the area is cleaned up and left in a presentable condition. MSP (Neisen /Pickar) To permit the transfer of the On -Sale and Off -Sale Intoxicating Liquor licenses, Sunday Liquor license, Cabaret and Restaurant Licenses of Bennett Goldberg, doing business as Mermaid Cocktail Lounge, Inc. to Donald Marrone and Charles Hall effective May 1, 1972 with the condition that the license transfers not take effect until proof of ownership is presented to the Clerk's office. MSP (Hodges /Baumgartner) To approve the cigarette license for Donald Marrone, doing business as Mermaid Cocktail Lounge, subject to the conditions set forth in the previous motion. 5 Ayes Mayor Neisen called the Eigenheer Rezoning Hearing to order at 8:33 P.M. Clerk Zylla read the legal notice and attested to its publication in the New Brighton Bulletin on April 13th and 20th. Hearing is to rezone Lot 2 and that portion of Lot 1, lying South of the water main easement, Eigenheer 3rd Addition, from R1 single family to R2 two family. Robert Eigenheer, owner of the property, explained his proposal. He stated that due to the necessity of having the area replatted at the request of the Planning Commission and the Village Council, a water main easement runs the entire length of Lot 1, causing Lot 1 to be unbuildable for a single family home. He therefore proposes to combine that part of Lot 1 lying South of the easement with Lot 2, creating a larger lot and constructing a two family residence. Mr. Robert Gaabo, 5249 O'Connell Drive, asked why the apartment building on Greenfield and O'Connell was built. Mr. Eigenheer answered that it was constructed to serve as a buffer to the commercial property. Mr. J. F. Fontaine, Jr., 5239 O'Connell Drive, asked why Mr. Eigenheer cannot build on Lot 1 and wanted to know whose fault it was. Mr. Eigenheer explained the lot was too small and that lot lines had been changed through replatting. Mr. Fontaine wanted a park for the lot, and expressed the belief that the residential area should not be changed. Mr. Eigenheer showed a house plan to the audience. Mr. William Lake, 5259 O'Connell Drive, stated that he has made an investment in his home and that a realtor with whom he had talked had stated that a double bungalow may decrease his property value. He stated he was opposed to the project. He also asked what is to stop Mr. Eigenheer from asking for a two family residence immediately South on Lot 3 which is now vacant. 4 Ayes l Johnson Naye 5 Ayes 1
