_7_ <br />June 23, 1975 <br />Mr. McLennan said Blaine is proposing the improvement of Judicial Ditch No. 1 <br />looking for Federal funding ($250,000.00). The drainage laws are so old <br />and archaic. The cost of repairing the ditch cannot exceed in one year the <br />original cost of the ditch. <br />Mr. McLennan said the intention of the holding ponds was to reduce the rate <br />of flow of water into the ditch. Water runoff close to the creek the idea <br />is to get it there soon, water runoff far from the creek should be held back. <br />It must reach the creek at a slow rate to prevent erosion of the banks. <br />Mr. Johnson said when this originally happened in April, Mr. Paster said the <br />holding ponds were designed by Rice Creek Watershed. <br />Administrator Achen replied Rice Creek had input into the design and it was <br />done in conjunction with them and Paster's designer. <br />Mr. Johnson said Paster refused to give him the name of their insurance <br />company but he managed to find out who the insurance company was. Nobody <br />wants to take responsibility for the damage. He doesn't feel the shopping <br />center should be allowed to continue construction. <br />Mayor Johnson addressed Ray Johnson, who said he was at the meeting only as <br />a viewer for Paster Enterprises, and asked him if he would agree to temporarily <br />taking whatever it may to pump the ponds. <br />Mr. Ray Johnson said he was not in a capacity to commit himself but could <br />not imagine that Paster would not be cooperative. <br />Mrs. Carol Ziebarth asked who is going to be responsible for the cost. <br />Mayor Johnson said a court of law would have to determine who is at fault. <br />Mr. Jerome Casey said he did not see a solution by draining water directly <br />down Highway 10 to Rice Creek. He ;till can't see how that will keep the <br />water from crossing County Road I. <br />Mayor Johnson said the storm water running into the catch basin will be <br />channeled through a conduit back of the shopping center. He added that <br />additional catch basins should be installed to take care of the water <br />running off the roof. <br />Administrator Achen questioned the storage of water on the roof. <br />Mr. Zimnewictz, State of Minnesota Building Code Department of Administration, <br />reported that he was at the meeting at Mr. Skiba's request. He said there <br />were no buildings that he knew of in this area that used the roofs as holding <br />ponds. He said the most a roof could hold should he 30 pounds f___ <br />r ..0 auJ per square foot <br />of water and 40 pounds per square foot of snow. He added that Burt Getsug <br />from Paster Engineering firm was uneasy and unhappy with water stored on the <br />roof. Rocfs are not designed to hold water in this climate because no one <br />knows for sure how much water will be frozen before snow falls on the roof making <br />more than 40 pounds per square inch. This condition could cause and has <br />caused collapse of buildings. <br />Mayor Johnson asked how many hours it would take to pump the pond. Mr. <br />McLennan said six hours to pump the northwest pond. <br />MSP (Johnson Shelquist) that construction on the shopping center be ceased <br />as of tomorrow morning and that the engineers from Rice Creek Watershed, <br />
