Page 5 <br />September 8, 1975 <br />MSP (Johnson Shelquist) to approve the preliminary plat of Briar Lake <br />dated August 18, 1975 subject to receipt of new soil boring data certified <br />by City staff and that the basement elevations of any homes constructed <br />on these six lots be at least five feet above the water table to be established <br />from soil boring data, and stipulating as follows: 1) no building permits <br />will be issued prior to May 1, 1975; 2) a certificate of occupancy will <br />not be issued for the occupancy of any dwelling until the utility and <br />street construction work of Project 1973 -4 has been completed; 3) it <br />will be understood by the applicant that construction of the utilities <br />will inconvenience home builders because the dewatering system will be <br />exposed; 4) if construction if commenced prior to construction of the <br />sanitary sewer, the home builder will be required to construct a ramp <br />over the sewer lines and that during a portion of the construction it <br />will be impossible to gain access to the property. 3 Ayes <br />Baumgartner Naye <br />Adminsitrator Achen reported the Planning Commission approved a request <br />by Robert Higgins for an oversized accessory building subject to receipt <br />of payment of the remaining $40 application fee. To date this has not been <br />paid. <br />MSP (Johnson- Hodges) to defer action on the request until such time <br />as the fee is paid. 4 Ayes <br />Administrator Achen reported the minor subdivision request of Jerry <br />Ackermann on Spring Lake Road had been approved by the Planning Commission. <br />Engineer Bearden explained that the present improvement project on Pleasant <br />View Drive does not provide sanitary sewer service to the proposed new lot- <br />He said services would have to be run in from Spring Jake Road or Pleasant <br />View Drive and that it would probably be more economical to run it from <br />Pleasant View. <br />Attorney Meyers stated the owner should be assessed at this time or should <br />sign something accepting the assessment. <br />Mayor Johnson asked Engineer Bearden if he could make a change order to <br />include this in the project. <br />Engineer Bearden said it could be added to the project, but the subdivider <br />would have to agree to be assessed, because it is too late to add it to <br />the assessment roles. <br />MSP (Johnson- Baumgartner) tc approve the minor subdivision of Jerry <br />Ackermann, 8454 Spring Lake Road subject to him agreeing to pay all the <br />special assessments applicable to 1973 -4 on the same basis as other <br />benefitted property owners affected by that improvement. <br />M -SP (Johnson- Shelquist) to amend the motion subject to his execution <br />of an agreement accepting an assessment for the new lot equivalent to <br />that of neighboring properties for the new streets, sewers and water <br />going in that area. In addition, that executed easement agreements for <br />drainage and utility purposes of 10 feet on the north and south boundaries <br />of both properties, of five feet on the west boundary and of five feet <br />each side of the new common line be granted. <br />Vote on the main motion. <br />4 Arles <br />4 Ayes <br />
