-2- <br />Admin. Achen stated that the Planning Commission approved the plat. <br />The major question involved is when to require removal of the <br />structures. We have to assure that the house is removed without <br />imposing too stringent conditions upon the property owner: Planning <br />Commission recommended July 1. <br />Mayor Johnson inquired as to whether he would enter into a develop- <br />ment agreement with the city and a bond, so that the city can be <br />assured that it will be removed. <br />Mr. Buzzel said that had not been raised before so we haven't <br />given it any consideration. Mr. Sakariason has been waiting on the <br />outcome before he relocates. The whole thing is conditional upon <br />the approval of the subdivision. He is assured that I have a buyer <br />and he has received a down payment. <br />Mayor Johnson explained that the only reason we have a bond is to <br />act as an impetus to make sure that you have the home removed by <br />July 1. Mr. Buzzel said that he would agree to that. <br />Atty. Meyers stated that the Council cannot approve a subdivision <br />that creates a violation of our subdivision ordinance. Admin. Achen <br />asked if the contract could be made airtight to meet the city's <br />requirement so that the sale can go through prior to the filing of <br />this plat. Approval would be on the condition that the buildings <br />be removed. That way you would protect the buyer, the seller and <br />the city. <br />Atty Meyers stated that he could only envision a development contract <br />and posting a bond for an agreement where the city could go in and <br />demolish the building. <br />Mr. Buzzel stated that they hoped to break ground on the 25th of <br />this month. The buyer's home is already sold and the financing <br />of this new home has a deadline of July 1. If it isn't granted he <br />cannot get u building permit which would hamper building of the home <br />on Lot 1. <br />MSP (Johnson Hodges) that we approve the major subdivision of Selmer <br />Sakariason for property on Sunnyside Rd. between Ardan Ave. and <br />County Rd. J, subject to the home being removed on the proposed <br />Lots2 3 and the garage being removed on Lots 3 4 prior to final <br />approval of the proposed major subdivision and the recording thereof. <br />A roll call vote was requested. <br />Councilman Shelquist aye Councilman Hodges aye <br />Councilman Baumgartner aye Councilman Pickar aye <br />Mayor Johnson aye <br />5 ayes <br />MSP (Shelquist Pickar) to adjourn the special hearing of Selmer <br />Sakariason at 8:45 p.m. 5 ayes <br />Mayor Johnson called to order the public hearing on the updating of <br />the Mounds View Comprehensive Plan at 8:46 p.m. Tne public hearing <br />was then recessed and the Council went back to the regular Council <br />meeting to hear more citizen requests. <br />
