Mayor Johnson stated ;that he will have difficulty with this as he <br />does not feel that there hs been sufficient showing that there isl <br />hardship and he feels that it is in the best interest of 'the City <br />planning function that the lot split remain on an even lot split <br />basis: this is a very paramount situation. We <br />have extended that to protect a situation where a house and garage <br />and two outbuildings exist, -as part of the consent agenda we should <br />hear an appeal from the Planning Commission- -this will be hard to defend <br />Councilman Baumgartner stated that some place you have to have some <br />compromise, to set a policy and state there will be no other <br />way, he objects to. <br />Councilman Shelquist stated that many residents have made the same <br />request and we have denied them. If you are going to show compassion <br />you better go back and at least change the policy and let them <br />do what they want to do with their land. <br />Councilman Baumgartner stated that each and every one should be treated <br />as a unique case. <br />Councilman Shelquist stated that he had heard no argument that the <br />sheds were grandfatherbi in and Mr. Anderson stated that Ms. Haake <br />had acknowledged that they had been grandfathereb-in so he had not refers <br />to them. They have been there about 30 years. <br />MS (Shelquist- Baumgartner) to adjourn the hearing. <br />Mayor Johnson said that he felt it would be very necessary for the <br />Council to make a statement that they are going to adhere to equal <br />lot splits. <br />:IS (Johnson Shelquist) that the expression of the City Council is <br />that in all cases barring; a showing of hardship, that the lot splits <br />be maintained on an equal basis. <br />Councilman Baumgartner inquired as to who deals with what the hardship <br />is and Mayor Johnson replied that that will be determined, but the Counci <br />has to show they are serious about equal lot splits. <br />Councilman Shelquist stated that a hardship exists when an owner cannot <br />build on the property legally.
