July 12, 1976 Page 9 <br />A roll call vote was requested. <br />Councilman'Pickar aye <br />Councilman Shelquist aye <br />Councilman Baumgartner aye <br />Acting Mayor Hodges aye <br />4 ayes <br />The administrator stated he was going to take this area back to the <br />Planning Commission to clarify it. Perhaps they should review it <br />and -:make a recommendation to the Council. <br />Councilman Shelquist said that Mr. Gustafson had stated that he had an <br />architect looking at the rest of his lots and he replied that we <br />hired him to come up with something. <br />Councilman Shelquist said that you anticipate coming back before us <br />then. Did he withdraw the additional lots? I still question the <br />kind of fee that he paid. <br />Councilman Shelquist stated that that is the point. You started develop <br />ing your land in one mode and now you are trying to change it. <br />Acting Mayor Hodges stated that we want to work with you and we will <br />talk to and direct our Planning Commission to look into the overall <br />plan for the area and ask you to work with them. <br />The administrator told tie citizens present that if the Planning <br />Commission does reconsider the comprehensive plan that their input would <br />very beneficial to them. <br />Mr. Houle stated that he appreciated 'Tr. Gustafson's problem but he <br />has benefited because the price of land has gone up. He is not hurting <br />that bad.. <br />There was a 5 minute recess. <br />PUBLIC IT. ^.PROV? "TNT PPOJE CT 1.75-4A <br />The administrator stated that this is the "ounds View Square Shopping <br />Center drainage. Since the puilic hearing there has been indications <br />of severe erosion. The staff prepared for Council consideration a <br />proposal to tile only that section of tne ditch adjacent to the SE <br />holding pond. The Council needs to make a decision on what it plans <br />to do. Similar plans have been prepared for a project less than <br />originally proposed and in accord with the staff report at the agenda <br />session. <br />The Administrator stated that he filled out one application and conferred <br />with the Planning Commission but he did not revise the application. <br />Mr. Gustafson stated that it all seemed like discrimination to him. H <br />is just trying to get out from under the taxes: He does not want to <br />lose his land. <br />John Bearden prepared the final plan :7 with the thought to extend the <br />culverts onto either side to get a lesser slope. Since that time the <br />fhoppinr Center has put in a bituminous curt;. <br />
