February 14, 1177 <br />Page 2 <br />Ms. Frankee stated that this has happened ,three times and three <br />different plumbers have -said- that -the pipes were too small to serve <br />a building of that size. She stated that the plugged pipe was on the <br />apartment property. <br />Councilmember Baumgartner stated that those apartments were built 8 or <br />10 years.ago and at that time the sewer lines were sized to the units <br />in t"at building. The sewer system had to have been inspected by the <br />City .and must have met the requirements. <br />Attorney Meyers stated that he would like to see a report from the <br />plumbing inspector. If this is a continuing problem the City should <br />look into it. <br />Mayor Picker stated that the inspector would look into this. He <br />stated that the City is behind the people and he does not like <br />the idea that a owner would take retaliatory measures against a <br />tenant. <br />Jack Dell, an attorney representing Brentwood Development, stated <br />that there are easement problems with the land they platted in <br />Auditors Subdivision 89. Mr. Bell explained that he found a <br />resolution, but it didn't include the land described as it is now. <br />Attornay Meyers explained that he had asked Mr. Bell to come to <br />the meeting. Resolution 721 would have taken care of the problem <br />except that there has been a change in the status of the land. <br />Attorney Meyers stated that he had asked '•Ir. Bell to prepare a <br />resolution ;.hat would do the job. <br />Engineer Hubbard stated that he had reviewed this resolution and <br />there may be one problem because it includes Lot 7, Block 2 which <br />is across the street. <br />Mr. Bell stated that it should be Lot 7, Block 1, but the easements <br />are in Block 2. Title Insurance is saying that they have to get rid <br />of the easements through the City or court. <br />Attorney Meyers stated that the Council could approve the resolution <br />conditionally subject to the Engineer checking it out further. If <br />the resolution is alright then the City can release it <br />Mr. Bell stated that he had also prepared some quit claii deeds to <br />the various owners. <br />MSP (Pickar- Ziebarth) to approve Resolution 80G and authorize the <br />Mayor and Administrator Clerk to execute appropriate quitclaim deeds <br />subject to approval of the City Engineer and Staff that this resolution <br />involves the same property as covered in P. solution 721. <br />Administrator stated that '9r. Bell had indicated that there were a <br />number of other easements and dedications that should be vacated. <br />Mr. Bell explained that there are easements of record other than <br />these that the County su99ested be removed but these are the rain <br />ones and the ones the title examiner objected to. <br />0 <br />4 ayes <br />
