January 23, 1978 LAUNCHING PAD SUPPER CLUB Mayor Pickar reported that the Launching Pad has requested the Council to release the remaining $500 the city holds in escrow as security for the licensing agreement executed last June. Mr. Hartinger should pay for the $530.30 in accumulated admini- strative charges regarding the remodelling requirements of the agreement. Attorney Meyers recommended that Council declare a portion of the escrow to be forfeited for non compliance with Secti ^n 7 of the agreement and that Mr. Hartinger pay the city's investigation, and legal costs related to the topless dancing incident, which amounted to approximately $190. Attorney Meyers also stated that at the second pre -trial hearing he moved that the charges be dismissed against Mr. Hartinger as his defense was saying that the owner was not on the premises at the time of the incident, and recommended that it be deemed a violation of the ordinance and thus was a violation of the contract he had entered into with the city. MSP (Pickar- Hodges) motiolt that the Launching Pad be refused the return of $500 that still remains in escrow and that they be billed for the $30.30 for the total amour,: of administrative costs that the Staff incurred to fulfill the agreement with the city. Attorney Meyers also pointed out that Mr. Hartinger had asked the Police Chief if the contest he planned on holding would be a violation, and that the Police Chief had consulted him and that he stated it would not be a violation but might be asking for trouble, which was conveyed back to Mr. Hartinger. Councilmember Ziebarth recommended that all the information be put in the Launching Pad's file and reviewed when their license is again up for renewal. BASEMENT REMODELLING BID AWARD Engineer Hubbard reported that the bids for Project 1978 -2 City Hall Improvements were opened January 19 and that four companies placed bids, and gave a presentation of the bids and the options the City had in awarding the project. He also stated that the costs of each option were construction costs only and that there would be additional costs for printing specifications, publications of notices, mailings and so forth. Engineer Hubbard reported that the low bid for the four options was received from Elview Construction, at $18,478.00, which was over the $14,300 budgeted for the project but that the additional expense could be covered by the Revenue Sharing fund. Councilmember Baumgartner questioned where the restroom would go and if would be one single restroom. Engineer Hubbard replied that it would go in the present storage area and would be a single, one stall restroom. He also stated that code requires one restroom per 15 people per floor. Councilmember Baumgartner questioned if the bids could be awarded for everything but the restroom. Engineer Hubbard replied that they could be but pointed out that the cost of installing a restroom at a later date would probably exceed the savings if the restroom were not installed in the package price.
