De amber 18, 1978 Page 6 <br />MSP (Pickar-Ziebarth) to refer the issue to the City Attorney for his <br />pinion. 5 ayes <br />Administrator Achen recommended that the City have a policy to cover <br />such occurrences. He added that he believed there is an informal policy <br />to treat these occurrences as acts of God. He recommended that the <br />Attorney prepare an opinion and proposed policy for Council action. <br />Councilmember Rowley asked when the two new police cars were to <br />arrive as she understood one of the squad cars had been involved in an <br />accident and was out of commission. <br />Administrator Achen replied that delivery was to be within 60 to 120 <br />days. He added that the Police Chief would like approval to go out <br />and purchase a vehicle off a lot to replace the unmarked car, will <br />be put into service in the interim. He also stated that the vehicle <br />had been considered totaled and they were not sure yet what insurance <br />would cover. <br />Councilmember Baumgartner pointed out that if the cost of the car is <br />over $5,000, they would be required by law to have bids. Administrator <br />Achen replied that he had not checked with the Attorney yet but he <br />believed if the Council determines it to be an emergency, they car. waive <br />the requirements. <br />MSP (Pickar Ziebarth) to authorize the Clerk- Administrator to purchase <br />a car, with the assistance of the Chief of Police, with the stipulation <br />'that it be cleared with the City Attorney as to the legality of the <br />transaction, and if it cannot legally be done at that time, that the <br />purchase be put in bid form, with the bid opening date to be January 5, <br />1979. The Council finds this is not an expenditure in excess of $5,000 <br />and does not require formal bids because less than $5,000 of City funds <br />will be required with the receipt of the insurance reimbursement from <br />the private party who was at fault. 5 ayes <br />Mayor Pickar stated that the years he has spent with the Council have been <br />good and hopefully to the benefit of the City. He added that he plans <br />on attending quite a few Council meetings and following up on the Mayor <br />Elects promises to the people.
