Mounds View City Council October 26, 1981 <br />Regular Meeting Page Six <br />'otion/Second: McCarty /Doty to authorize the <br />ity Attorney to send a letter to the Met <br />Council, informing them of the City's position <br />on the instrument landing system and ask for <br />their response, and if that response is not <br />received within a two week period, further <br />authorize the City Attorney to take further <br />action. <br />5 ayes 0 nays <br />Clerk /Administrator Pauley reviewed the <br />October 23, 1981 memo from Dan Boxrud, regard- <br />ing trunk storm drainage facilities, as well <br />as the'October 22, 1981 memo from Attorney <br />Meyers to Richard Korsche, the attorney for <br />Kraus /Anderson, regarding the City's position <br />on SDM charges. <br />There was considerable discussion regarding <br />SDM charges, whether a credit might be owed, <br />calculating run -off, DP -47 and 73 -4, preli- <br />minary projections of the SDM charges to be <br />accessed to the Kraus /Anderson project, whether <br />Kraus /Anderson was required to put in a system <br />n excess of what was necessary, and reviewing <br />the report from Sundae as to whether oversizing <br />was required. <br />Attorney Meyers stated that credits are to be <br />issued only if they are assessed for more than <br />what is necessary, and thus a determination <br />must be made if Kraus /Anderson was assessed <br />for more than what was required of them, in <br />which case a credit could be called for. <br />It was the concensus of the Council that <br />the issue should be discussed and resolved <br />at the next Agenda Session. <br />Clerk /Administrator Pauley reviewed his memo <br />of October 15, 1981 to the Council, regarding <br />MSA funds, giving Staff's recommendation that <br />the City purchase the right -of -way for MSA <br />streets in Silver Lake Woods, in order to not <br />lose MSA funds by having the account balance <br />exceed $300,000 at year end. <br />'here was considerable discussion on the <br />,.:ecessity and advisability of purchasing <br />the right -of -ways to use up the money chat <br />otherwise might be lost, with the points being <br />made that Mounds View tax payers had paid these <br />Motion Carried <br />11.
