Mounds View City Council October 10, 1983 <br />Regular Meeting Page Nine <br />Motion /Second: Linke /Hankner to take the item from <br />the table. <br />5 ayes 0 nays <br />Motion /Second: McCarty /Doty to set the appointment <br />date for the Chief of Police for November 14, 1983. <br />5 ayes 0 nays <br />Mayor McCarty reviewed the preliminary report of the <br />draft airport plan for the Anoka County airport, and <br />asked that all Councilmembers receive a copy. <br />Motion /Second: McCarty /Doty to authorize Attorney <br />Meyers to implement the lawsuit on the ILS System at <br />such time that he deems proper, should the Met Council do <br />anything contrary to law. <br />4 ayes 0 nays 1 abstention <br />Councilmember Hankner stated she was abstaining from <br />the vote as she would like a chance to confer with <br />Attorney Meyers about the status of the current <br />lawsuit before authorizing another to be filed. <br />Attorney Meyers advised that they could amend <br />the lawsuit to include another party, as the current <br />suit is against the Met Council, and any new law- <br />suit would be against MAC. He added he would prefer <br />to keep the case in Ramsey County. <br />Mayor McCarty asked Councilmember Hankner for an <br />aye or nay vote on the previous motion, and had <br />Attorney Meyers quote the section of the code <br />which requires a unanimous decision by all Council <br />members to let one member abstain from a vote. He <br />stated he was not allowing her to abstain. <br />Councilmember Hankner stated she would vote nay on <br />the previous motion, for the same reason as she <br />abstained, that she did not have enough information <br />to approve the motion at this time. Councilme Linke <br />said he would have voted to uphold Councilmeml Hankner's abstention. <br />Clerk /Administrator Pauley reported negotiations <br />were going on between Mr.Dinndorf and Mr. Gaughan <br />and that a section of Mr.Dinndorf's driveway had <br />been replaced and that the issue of fill will be <br />decided soon. <br />Clerk /Administrator Pauley reported he had attended <br />the Met Council committee meeting on the Metro Housing <br />Fund, and reviewed the actions taken at that meeting. <br />Motion Carried <br />Motion Carried <br />17.
