No. 349 <br />the City of Mounds View by repealing Chapter 35, <br />entitled "The Festivities Commission and <br />adopting a new Chapter 35 entitled "Mounds View <br />Festivities Commission and waive the reading. <br />5 ayes 0 nays <br />Councilmember Linke reported the Festivities Commission <br />has reviewed and agreed with the changes made. <br />Motion /Second: Linke /Hankner to have the second <br />reading and adoption of Ordinance No. 341, amending <br />the Municipal Code of Mounds View by amending <br />Chapter 41 entitled "Specific Rezonings and <br />waive the reading. <br />Councilmember <br />Councilmember <br />Councilmember <br />Councilmember <br />Mayor McCarty <br />Hankner aye <br />Blanchard aye <br />Doty aye <br />Linke aye <br />aye <br />Motion /Second: Doty /Blanchard to approve Resolu- <br />tion No. 1664, authorizing the Clerk /Administrator <br />and Mayor to execute Development Agreement No. 83 -62, <br />and Ordinance No. 346, amending the Municipal Code <br />of Mounds View by amending Chapter 41 entitled <br />"Specific Rezonings and waive the reading. <br />Councilmember <br />Councilmember <br />Councilmember <br />Councilmember <br />Mayor McCarty <br />Hankner aye <br />Blanchard aye <br />Doty aye <br />Linke aye <br />nay <br />Mayor McCarty explained he had voted against the <br />motion as it went against the Comp Plan, and <br />he was not comfortable not having an assurance <br />that it wouldn't turn into another type of <br />business in the future, as it is a residential <br />district. He explained he was not present at <br />the first meeting and was not comfortable with <br />the information before him. <br />Discussion occurred before the vote on the motion, <br />with Mayor McCarty asking if there was a guarantee <br />in the development agreement that the business <br />could not be sold or changed to something else, <br />and Councilmember Doty inquiring about the sprink- <br />ling requirements. <br />Attorney Meyers pointed out that a 4/5 vote was <br />needed on the motion. <br />Motion Carried <br />8. 2nd Reading and <br />Adoption of <br />Ordn.
