Mounds View City Council August 24, 1987 <br />Regular Meeting Page Thirteen <br />4Ik Attorney Meyers replied all conditions would have to <br />be in the ordinance and be uniform with all similar <br />businesses in the City. He added he has informed <br />Mr. Povlitzki and his attorney that the City would <br />like to return as close as possible to the restaurant <br />operation that was originally run in that location, <br />with liquor being incidental. <br />Mr. Zwieg asked whether the previous owner was suing <br />the City. <br />Attorney Meyers replied he has heard they are consider- <br />ing a lawsuit, as the City took away their liquor <br />license. <br />Mr. Zwieg asked why the taxpayers should have to pay <br />legal fees to get the operations closed down. <br />Attorney Meyers replied the property owners have rights <br />also, and the zoning is proper for what Mr. Povlitzki <br />has requested. <br />Mr. Povlitzki also pointed out that times change and <br />with it the types of businesses. <br />=Attorney Meyers pointed out that Mr. Povlitzki is aware <br />that he will be watched closely by the City and will <br />have to conform. <br />Tim White, 5249 Greenfield, stated the City had the <br />same problem for several years with the past owner <br />and stated the Council should be on top of the situation <br />from the very beginning and make sure the problems do <br />not repeat. <br />Mayor Linke answered that while the City cannot provide <br />assurances there won't be problems, they can keep a <br />close eye on the operation. <br />Councilmember Hankner reviewed the history of problems <br />with the previous owner, and why the Council did not <br />reissue the liquor license to him. <br />Mr. White asked the Council to rezone the property to <br />get a better type of business there. <br />Mr. Povlitzki stated he was more than willing to sell <br />the property to the residents, and they could open what- <br />ever business they would like, or knock down the building <br />if they wanted to. He said he'd gladly sell if he could <br />just break even on what he owes at this point. He added <br />that he must have the business open to generate an income. <br />
