Mounds View City Council August 24, 1987 Regular Meeting Page Thirteen 4Ik Attorney Meyers replied all conditions would have to be in the ordinance and be uniform with all similar businesses in the City. He added he has informed Mr. Povlitzki and his attorney that the City would like to return as close as possible to the restaurant operation that was originally run in that location, with liquor being incidental. Mr. Zwieg asked whether the previous owner was suing the City. Attorney Meyers replied he has heard they are consider- ing a lawsuit, as the City took away their liquor license. Mr. Zwieg asked why the taxpayers should have to pay legal fees to get the operations closed down. Attorney Meyers replied the property owners have rights also, and the zoning is proper for what Mr. Povlitzki has requested. Mr. Povlitzki also pointed out that times change and with it the types of businesses. =Attorney Meyers pointed out that Mr. Povlitzki is aware that he will be watched closely by the City and will have to conform. Tim White, 5249 Greenfield, stated the City had the same problem for several years with the past owner and stated the Council should be on top of the situation from the very beginning and make sure the problems do not repeat. Mayor Linke answered that while the City cannot provide assurances there won't be problems, they can keep a close eye on the operation. Councilmember Hankner reviewed the history of problems with the previous owner, and why the Council did not reissue the liquor license to him. Mr. White asked the Council to rezone the property to get a better type of business there. Mr. Povlitzki stated he was more than willing to sell the property to the residents, and they could open what- ever business they would like, or knock down the building if they wanted to. He said he'd gladly sell if he could just break even on what he owes at this point. He added that he must have the business open to generate an income.
