Page 3 <br />August 26, 1996 <br />Mounds View City Council <br />Simon <br />Universal Sign, Inc. -Renewal <br />HVAC <br />Metro Gas Installers -New <br />Kennel -Renewal <br />Sham-O-Jet Kennels -Commercial <br />Richard and Julie Oliverius -Residential <br />Mary Niezgocki -Residential <br />MOTION/SECOND: TrudeBianchard to approve the Consent Agenda as presented. <br />VOTE: 5 ayes 0 nays Motion Carried <br />RESIDENTS REQUESTS AND COMMENTS FROM THE FLOOR. <br />Mayor Linke explained that this portion of the meeting was designated for anyone who wished to speak to <br />the Council on items that were not on the Agenda. <br />Duane McCarty, 8060 Long Lake Road, stated he had a couple of questions in regard to the Anoka County <br />Airport that have come to mind since the last council meeting, in particular in regard to the 1980 law that <br />the city relied upon to hold the Anoka County Airport within its minor classification. He stated the <br />Metropolitan Airports Commission has said that the 19801aw did not specifically say that they must <br />maintain that given development guide at that particular point and time. Mr. McCarty asked if there has <br />been some discovery that would support MAC's position on this issue, and secondly the court decree <br />mentioned that MAC should proceed in accordance with the law and the 1980 master plan - so he questions <br />whether or not that master plan was totally compliant to the 19801aw that held Anoka County Airport to its <br />minor status. Therefore the two issues he feels must be addressed are the 19801aw's application to the <br />development guide at that time and whether or not the 1983 master plan is in full compliance with that <br />19801aw. He would like the city attorney to do some research and answer these questions. <br />PUBLIC HEARINGS: <br />Public Hearing to Consider PUD Amendment to Increase Parking and Development Review for <br />Everest Property at 5251 Program Avenue. <br />Mayor Linke opened the Public Hearing at 7:15 p.m. <br />Ms. Sheldon, Community Development Director, explained that this request from the Everest Property <br />Management is to increase the number of parking spaces on their property by 35 spaces. The total parking <br />spaces would then increase to 500 spaces. Their desire is to meet the demands of a tenant interested in <br />locating to the business park. The recommendation of the Planning Commission and staff is to approve <br />the request with the following contingencies: <br />1) that Everest Development, Ltd. enter into a development agreement with the City of Mounds View; <br />2) that a landscaping plan be submitted and installed, subject to the approval of the City Forester; <br />
