Mounds View City Council Page Six <br />Regular Meeting February 8, 1993 <br />Bill Frits asked when the description of the County "ditch" changed <br />to boulevard. <br />Mayor Linke stated that this area has always been called a right-of- <br />way, or boulevard, however, they all refer to the same area. <br />MOTION: Blanchard to Substitute Mr. McCarty's Rewritten <br />Version of Ordinance No. 522 for the Proposed Ordinance <br />Mayor Linke called for a second to this motion three times. <br />Councilmember Rickaby seconded the motion. Councilmember Rickaby stated <br />that she would like to amend the substitute motion to incorporate the <br />written permission of the original motion in the last two paragraphs <br />which would give clearer language to the substituted motion. <br />Councilmember Rickaby stated that on the substitute motion there is <br />no written permission so there would be no reason to add this. <br />McCarty stated that there is need for permission as these are the kinds <br />of things that neighbors can work out. The less government reaches into <br />private lives of citizens, the better off everyone will be. The City <br />needn't get involved in the neighbor to neighbor situation or the <br />resident's private lives. Mr. McCarty stated that in the beginning he <br />thought the City was concerned with public property to public property. <br />Mayor Linke stated that problems start when a snowplow operation from <br />a commercial piece of property begins pushing snow across the street <br />onto private property. <br />Mr. McCarty stated that a snowplow cannot move snow across the street <br />without dropping snow on the street or boulevard. The curb would <br />stop them from doing so. <br />Councilmember Rickaby withdrew her second on the substitute motion. <br />Councilmember Quick stated that it is necessary to have permission to <br />deposit snow on other people's yards. People cannot always work <br />together. Quick stated that he has a situation where it works both <br />ways. Quick stated that a large area could be plowed up, carried over <br />and dumped in someone's front yard. <br />McCarty stated concern with the ordinance being adopted because of <br />three people out of the 12,853. <br />McCarty stated that per Robert's Rules of Order once a motion has <br />been seconded and discussion has begun, the seconder cannot withdraw <br />his second on the motion. The Council would be in violation of <br />. Robert's Rules. <br />
