68 <br />Mr. John Koontz, Building Inspector, appeared before the council to report what <br />appears to be a violation of the building code by Mr. Benthrup at 8159 Red Oak Drive. <br />Mr. Koontz stated that the house of Mr. Benthrup was built into a double bungalow instead <br />of the single unit dwelling for which the building permit was issued. 1'r. Koontz <br />also reported that another family is living there but that Mr. Benthrup stated they <br />are his guests. After discussion a motion was made by Sullivan, seconded by Smith that <br />Mr. Benthrup, 8159 Red Oak Drive, be written. a letter requesting his appearance at the <br />council meeting of May 18 in regards to his property and also request that the building <br />inspector be present at the meeting of May 18 with a copy of the building plans <br />presented to him at the time the permit was issued in June 1958. Trustee Sullivan <br />also moved that Mr. Benthrup bring with him his plans for the house in which he is in <br />the process of building at 8159 Red Oak Drive, formerly known as the Virkinis house. <br />Motion carried unanimously. <br />A Curfew 0rdinanc.e was read by Mayor Gibson. Motion by Sullivan, seconded by <br />Smith that the council refer the curfew ordinance to the committee appointed for that <br />purpose for consideration and recommendation and that formal action be taken at the <br />next council meeting on May 18. Smith, Christensen, Sullivan, aye; Gibson, no. <br />Motion by Sullivan, seconded by Phristensen that a letter be written to Northwest <br />Hydrogas Company requesting a representative of that company appear at the May 18th council <br />meeting in regards to a report by the Heating Inspector that said company is operating <br />in the village without a heating contracting license. Motion carried unanimously. <br />Motion by Gibson, seconded by Christensen that T signs be installed on Jackson <br />Drive at Pinewood, Terrace, Oakwood and. Hillview. Motion carried unanimously. <br />Motion by Sullivan, seconded by Gibson that load restriction signs in the village <br />be removed. Motion carried unanimously. <br />Motion by Gibson, seconded by Sullivan for approval of the notice of weed publication <br />in the papers. Motion carried unanimously. The council directed that a letter be <br />written to Mr. Van Elsberg, Weed. Inspector, instructing him to appear at the May 18th <br />meeting of the Village Council for discussion of the weed situation in the village. <br />Mr. Skiba, Plumbing Inspector, appeared before the council with information that <br />a citizen of the village had complained to him in regards to the depth of wells allowed <br />to be built by contractors within the village. The complaint was stated that his well has <br />been causing much trouble because of the shallow depth. After much discussion of the <br />depth of wells in the village the council felt that this was not 'a council problem <br />and that the owner of said property must ask relief of this situation from the contractor <br />who installed such well. <br />Motion by Sullivan, seconded by Christensen to approve an expenditure of not more <br />than $75.00 to be used. by Mayor Gibson in connection with his attendance at the <br />Minnesota Municipalities Convention. Motion carried unanimously. <br />Motion by Christensen, seconded by Sullivan that the Civil Defense Director be <br />allowed to order necessary badges and caps for new men graduating from Civil Defense <br />classes. Motion carried unanimously. <br />Mayor Gibson read a letter addressed to Trustee Achterkirch from the Chief of <br />Police, John Och, stating with regret that he was tendering his resignation. effective <br />May 31st, as per letter directed to him at the last meeting of the Village Council. <br />Meeting was set for May 6, 1959 at 9:30 P.M. at the Village Hall with the Police <br />Commission and the Council. <br />
