2 <br />Mayor called rezoning hearing to order at 8:35 P.M. Deputy Clerk read legal <br />notice and attested to its publication in the New Brighton Bulletin October 17 <br />and 24. Hearing previously held September 23 for same request. Legal: <br />Parcel (1) except the N 150' of Lot 59, Auditors Subdivision #89, R1 (residential) <br />to R3 (multiple dwelling). Parcel (2) except the W 100' lying Northerly or <br />Southerly 514.63' of Lot 58, Auditors Subdivision #89, B3 (general business) to <br />R3 (multiple dwelling). Project includes two 23 unit and one 17 unit apartment <br />building, pool and garages. Petitioner Dan Vaughn presented petition for the <br />rezoning signed by over 60 residents of the area. Mayor asked if anyone in <br />audience for the rezoning. Robert Eigenheer, Andrew Simon, Chuck Larson. <br />Mayor called for objectors. None. Hearing closed at 8:50 P.M. <br />MSP (Johnson /Malvin) To grant the rezoning. <br />4 Ayes <br />David Yurkew, a tenant in the Siwek Apartments, inquired as to whether the buildings <br />had been checked and approved by the inspectors. Council replied yes and the <br />Village is responsible for upholding the codes originally. Other tenants <br />desired knowledge on personal recourse against Siwek who supposedly has ignored <br />tenant requests for improvements. Siwek was meeting with inspectors and fire <br />chief this evening to discuss remedies against fire problem caused last Saturday. <br />Asbestos will be tried under furnace. Jerry Scott in favor of asbestos. Also <br />stated heater flow backwards. Inquired as to who determines who will insect <br />for the Village. Desires better building inspector. Would like it reinspected. <br />Electrical inspector rebutted criticism and was defended by fire chief. Mayor <br />asked for written reports from all inspectors. <br />MSP (Lang /Johnson) To authorize reinspection of Siwek Apartments. 4 Ayes <br />MSP (Malvin /bang) To approve final plat of Feige Addition and to authorize the <br />Mayor and Deputy Clerk to sign. 4 Ayes <br />Anthony Holchuh showed Council new preliminary plat. <br />Ken Ballenger and Mrs. James Borofka inquired into contractor working all night <br />on 35W. Road belongs to contractor until turned over to the state. Clerk's <br />office to write letter to Barton Contracting Company requesting some consideration <br />be given to installing a temporary light at Pinewood and TH8, placing additional <br />signs on the bypass, and alleviating some of the noise after normal working hours. <br />Mayor Rustad's Report <br />MSP (Rustad /Malvin) To order the installation of a street light at Adams and <br />Groberg streets. Petition received. <br />Mayor read Planning Commission minutes of October 15, 1968. <br />MSP (Johnson /Lang) To approve square foot variance for Rocket Development Corp. <br />to construct an apartment building at 59- 0080 - 080 -29. <br />4 Ayes <br />3 Ayes <br />Rustad Abstained <br />Discussion followed on whether our square footage requirements are too stringent. <br />Planning Commission to be notified to take under advisement. <br />MSP (Johnson /Lang) To approve plans and specifications for Towns Edge Terrace <br />Mobile Home Park. 4 Ayes <br />
