4 <br />MSP (Blanchard /Malvin) To approve Resolution #434 abating 33 feet of water <br />and sewer assessments on Parcel #59- 0080 - 140 -29 (refer to Division #39791). <br />Total abatement $348.15. <br />Attorney Meyers presented a subdivision filed by F. N. Shaffer Realty Company, <br />George Gustafson agent, which called for an additional assessment. <br />MSP (Johnson /Hodges) To approve the subdivision of Lot 72 Spring Lake Park <br />Hillview Addition subject to the signing of the additional assessment agreement <br />or the payment of the additional assessment. <br />The attorney presented a resolution releasing certain easements on Lots 1 -8, <br />Block 1 Parkview Terrace. Easements are utility and drainage easements which <br />no longer are necessitated. <br />MSP (Rustad /Hodges) To rescind Resolution #428 previously passed abating <br />easements in Parkview Terrace. <br />MSP (Rustad /Johnson) To approve Resolution #435 vacating, releasing and <br />discharging certain utility and drainage easements in above mentioned Parkview <br />Terrace on said Lots 1 -8. <br />Attorney Meyers presented his resume' of senate file #237, Metropolitan Sewer <br />Bill. <br />Attorney Meyers also read a memorandum regarding public hearings relative to <br />rezoning. In essence it stated the Planning Commission may hold public hearings <br />but if this is the case the Council should act as an appeals board so that no <br />one is denied their rights under the due process clause of the constitution. <br />Mayor Rustad stated that at the Planning Commission meeting of January 21st <br />the Planning Commission had recommended to issue a special use permit to Mr. <br />William Gillespie to sell cars at 2045 Highway #10. The Council advised that the <br />Planning Commission should readvise Mr. Gillespie to either attempt to have the <br />property permanently rezoned or to drop the matter. That a special use permit <br />could not be issued since the property is zoned R1. <br />5 Ayes <br />5 Ayes <br />5 Ayes <br />5 Ayes <br />MSP (Johnson /Malvin) To approve Ordinance #163 rezoning all property in the <br />Village of Mounds View presently zoned shopping center S -C to commercial B3. 4 Ayes <br />Blanchard Naye <br />Engineer Boehm's Report <br />Engineer Boehm presented the proposed plat for Dailey Homes. Daileys Red Oak <br />Plat Estates contained eight lots. Engineer's office has corrected the previously <br />incorrect legal description on the proposed plat. <br />MSP (Hodges /Johnson) To approve the preliminary plat for Dailey Homes Inc. <br />Subdivision is South of 8290 Red Oak Drive. 5 Ayes <br />Engineer presented plans and specifications for Street Improvement Project 1969 -1 <br />continuation of Sewer and Water Improvement Project 1968 -2 Parkview Terrace. <br />The engineer also presented specifications for the improvement of Well #1. Well <br />in general is lacking pumping capability which it originally had when it was first <br />installed and the Council had felt that the pump was in need of a general overhaul. <br />MSP (Hodges /Johnson) To approve plans and specifications and to set the bid date <br />for 12:00 noon February 24th. 5 Ayes <br />
