- 2 - <br />Attorney Meyers reported that we have a highway easement from R. Eigenheer <br />for the W 30' of Lot 14 Block 2 Greenfield Addition. <br />MSP (Blanchard /Malvin) To approve Resolution #438 deeding to R. Eigenheer <br />the E 33' of W 163' of Lot 14 Block 2 Greenfield Addition. <br />Engineer Boehm's Report <br />3 Ayes <br />MSP (Malvin /Blanchard) To approve Change Order #1 for the repair of <br />Well #1. Adjusted contract price $4,936.00. 3 Ayes <br />MSP (Rustad /Malvin) To approve Change Order #1 for 1968 -3 Schedule A. 3 Ayes <br />MSP (Blanchard /Malvin) To approve Change Order #2 for 1968 -3 Schedule A. 3 Ayes <br />MSP (Malvin /Rustad) To approve the final payment for Aamot Well Company <br />for Project 1968 -3 Schedule A, check #3224 for $3,343.50, and to enter into <br />a one year warranty period. Completed contract price $14,998.50. 3 Ayes <br />Engineer Boehm suggested that the Council consider routing the water mains <br />for 1968 -3 to conform to the street pattern in the Pinecrest Properties <br />project. <br />Engineer Boehm also reported that none of the test wells for 1968 -3 <br />Schedule A were satisfactory. <br />Rezoning hearing called to order by Mayor Rustad at 8:30 P.M. Clerk <br />Zylia read the legal notice and attested to its publication in the New <br />Brighton Bulletin April 3rd and 10th. The South 300' of Lot 61 Auditors <br />Subdivision No. 89. Rezone from R1 (Residential) to B3 (Commercial). <br />Mr. Gillespie, petitioner, spoke on his proposal to sell used cars and <br />do minor repair work. The following persons spoke against the rezoning: <br />Mr. James Gable, 7934 Fairchild - would destroy property value. <br />Mr. Arnold Scholljergerdes, 7950 Fairchild- object sane reason, and can't <br />get FHA loans. <br />Mr. Robert Larson, 7960 Fairchild - messy, buffer not adequate. <br />Mr. Jerome Rickard, 7980 Fairchild - object same reason. <br />Mr. Robert Shelquist, 8025 Fairchild - village planner said residences <br />should be protected, this is spot rezoning, no opportunity to buffer it, <br />:. <br />Mr. Palmer Larson - used car lot detrimental. <br />Mrs. Robert Shelquist - would set a precedent on Highway #10, single family <br />residences must be protected. It is up to Gillespie to accomodate people. <br />Mayor Rustad closed the hearing at 8:25 P.M. No formal action can be taken <br />at this time because only three members present and a 4/5s vote is needed. <br />Councilman Blanchard commented that he would vote against. <br />Councilman Malvin had no comment.
