- 4 - <br />Meeting reconvened at 9:10 P.M. <br />Councilman Blanchard read a letter from the Human Rights Commission requesting <br />that the commission be authorized nine members. Attorney Meyers advised that he <br />had the ordinance amending the Human Rights Commission ordinance in his possession <br />this evening and would present it during his report. <br />Street vacation hearing called to order by Mayor Rustad at 9:12 P.M. <br />MSP (Rustad /Malvin) To dispense with the reading of the legal notice. 4 Ayes <br />Street to be vacated at the public right -of -way easement described in Document <br />#522158 in that part of the SE 1/4 of the SE 1/4 of Section 8, Township 30, <br />Range 23 running across the property presently owned by Superior 400 Oil Company <br />northwest of the intersection of Highway #10 and Highway Avenue. <br />The Mayor called for objectors. There were none. <br />MSP (Malvin /Johnson) To approve Resolution #444 approving the street vacation <br />subject to obtaining a quit claim deed from Superior 400 for the street which <br />will be replacing the existing street. 4 Ayes <br />Walter Skiba requested information on waiving the permit fee for Pinewood School <br />MSP (Johnson /Blanchard) To waive the permit fee. 4 Ayes <br />Attorney Meyertt Report: <br />Attorney Meyers stated that a restraining order will be issued on Mr. Kenneth <br />Krager if all merchandise on his lot is not removed by July 23rd. Mr. Krager <br />was recently found guilty by the New Brighton Court also. <br />Attorney Meyers stated in speaking of the NSSSD resolution which he was requested <br />to prepare, that the resolution should include the exploration of all possibilities <br />of refund, that the Metro Board take over the plant sight, that all construction <br />cease, and that the use agreement be terminated. <br />Attorney Meyers also stated that he has requested an attorney generals opinion on <br />the legislative law tach changed the fine and the punishment for a misdemeanor to <br />$300.00 and /or 90 days. <br />Attorney Meyers was also directed to amend Ordinance #141 regarding street openings <br />to allow contractors to post a deposit which will not be refunded until the contractor <br />reqpirs the street to the satisfaction of the village. <br />MSP (Rustad /Johnson) To approve Ordinance #166 amending Ordinance #155 <br />establishing a Human Rights Commission. The amendment changes the number of <br />members on the Commission from 5 to 9. <br />Engineer Boehm's Report <br />MSP (Rustad /Malvin) To accept the bids for Sanitary Sewer and Water Project <br />1969 -3 and to award the bid to Randall Brothers, 3 400 Silver Lake Road, Minneapolis <br />in the amount of $43,805.00. <br />4 Ayes <br />
