Attorney Meyers' Report <br />Attorney Meyers stated that he received a notice of hearing for June 24th <br />in which the Metropolitan Council is determining the sewer service areas. <br />He also stated that a request by Red Oak Estates Development et al to have <br />their case advanced in District Court had been turned down. The Court felt <br />the case involved land speculation and had no irreversible harm so the matter <br />was denied. <br />Attorney Meyers stated that there will be two school assessment appeals coming <br />up for hearing on May 20th, and that one which was scheduled to be heard <br />May 21st was dismissed. <br />A letter of intent on flood plains was referred to the office. <br />Attorney Meyers stated he had received a call from Ery Herbst requesting <br />action to obtain a 30' easement off of the East side of the Edgewood School <br />property. The Council felt that Mr. Herbst should contact the School Board <br />directly to obtain their feelings on the easement. <br />MSP (Blanchard /Hodges) To approve Ordinance #175 establishing the street <br />name of Ardan Avenue. <br />MSP (Malvin /Hodges) To approve Resolution #480 establishing a parking <br />restriction on one side of Ardan Avenue between Red Oak and Groveland Road. <br />Attorney Meyers presented a $5,000 check from State Auto Insurance and $500 <br />in checks from the Emerald versus Mounds View case award. <br />Engineer Boehm's Report <br />Engineer Boehm stated that he had ascertained that the property requested by <br />the Spring Lake Park Lutheran Church on Ardan Avenue is approximately a quarter <br />acre. The Council is to consider which action they want to take on releasing <br />all or a portion of this land to the Spring Lake Park Lutheran Church. <br />Engineer Boehm stated that he received a request to determine the proper align- <br />ment or stakes for the Erickson Road walkway and he found that the easement is <br />in the proper place and that a 12' strip North of the easement belongs to Mrs. <br />Erickson. <br />Engineer Boehm gave a brief progress report on Improvement Project 1968 -3. <br />The Council discussed back washing and whether it is being disposed of correctly <br />into the sanitary sewer system or into the surface water drainage system and then <br />into Rice Creek. <br />MSP (Malvin /Neisen) To adjourn at 10:00 P.M. <br />pectfully Submitted, <br />Dennis S.
