3 - <br />The Planning Commission also recommended that Attorney Meyers clarify Section 3.4 <br />of the Zoning Ordinance. <br />MSP (Neisen /Johnson) To authorize Attorney Meyers to prepare an amendment to <br />the Zoning Ordinance to allow detached garages in the side yards. <br />Attorney Meyers° Report <br />No action was taken on the proposed amendments regarding combining the office of <br />Clerk- Treasurer, amending the subdivision ordinance to require 10% cash contri- <br />bution or to amend our traffic ordinance to adopt the 1971 session traffic laws. <br />Attorney Meyers reported that the Mounds View versus Lloyd Moen lawsuit would be <br />coming to court in Blaine on Monday, November 15th. <br />MSP (Johnson /Hodges) To move to exclude Mounds View from the Alabama lawsuit <br />therefore avoiding being subject to pretrial discovery and the prorata share of <br />the court costs and not to be bound by the judgement. Also authorizing the <br />Village attorney to complete the necessary forms and serve name on the Clerk of <br />the Court in the Northern District of Alabama to take whatever steps and actions <br />necessary to protect and represent the interest of the Village in this litigation. <br />This litigation involves the suit against cast iron pipe manufacturers for <br />conspiring to fix prices. <br />MSP (Neisen /Johnson) To accept the preliminary report and cost estimate for <br />Storm Sewer Improvement Project 1971 -2 Eigenheers Second and Third Additions. <br />Engineer Boehm reported on a conference which he attended which involved the <br />Federal Aid Urban System concept the secondary road system in the metropolitan <br />area. County Road J between 35W and the west corporate limit was designated in <br />the system. No action was taken at the request of Mr. Boehm to pass a resolution <br />authorizing Village approval of this road designation until it was determined <br />that Ramsey County was interested in sharing in the cost of this system. <br />3 Ayes <br />3 Ayes <br />3 Ayes <br />MSP (Johnson /Hodges) To authorize Engineer Boehm to proceed with the preliminary <br />application for federal funds for a Village storm sewer system. 3 Ayes <br />MSP (Neisen /Johnson) To authorize Engineer Boehm to check into the position of <br />various municipalities north of the corporate limits relative to Judicial Ditch #1. 3 Ayes <br />Engineer Boehm also reported that Johnson Brothers have a December 1st completion <br />date for Project 1971 -1 and that they will have no problem meeting this date. <br />Mrs. Barbara Haake presented a letter from the Provisional League of Women Voters <br />thahking the various Village officials and staff for the assistance that was given <br />them relative to various voter service projects. <br />MSP (Hodges /Johnson) To adjourn at 9 :58 P.M. 3 Ayes <br />Respectfully Submitted, <br />ennis a, <br />Clerk- Admihristrator <br />
