- 3 - <br />MSP (Neisen /Johnson) That Keith Harstad be required to have a soils report <br />by an accredited testing lab on the property to be considered for commercial <br />and townhouses at the hearing scheduled for January 24th, and that it be furnished <br />to the Planning Commission before any action is taken by them in referring the <br />matter to the Village Council. <br />The construction plans of the Martin Oil Company were referred to the Planning <br />Commission in conformance with the Council policy hereby adopted which henceforth <br />provides that any construction plans for commercial, industrial, or apartment <br />buildings be referred to the Planning Commission for their recommendation prior <br />to the issuance of the building permit. <br />Attorney Meyers' Report <br />Attorney Meyers reported that he has filed a copy of Ordinance #64, the <br />Subdivision Regulations, with the Register of Deeds. In conformance with <br />Ordinance #64, he stated that in the future all plats must have a hearing <br />before approval. <br />On rezoning matters Mr. Meyers stated that there are three methods by which a <br />rezoning may be initiated. The first being by a 50% petition of the owner, <br />second by initiation of the Council, and third by initiation of the Planning <br />Commission. <br />MSP (Neisen /Hodges) To approve the settlement of $2,500.00 by the Reliance <br />Insurance Company on the Mounds View versus Lloyd Moen lawsuit and to authorize <br />the Mayor and Clerk to execute a release. <br />Attorney Meyers presented the check to the Clerk. <br />MSP (Blanchard /Hodges) To authorize the Attorney and staff to prepare an <br />administrative petition acting under the procedures set forth by the Metropolitan <br />Sewer Board for the purpose of seeking relief from our $96,500 sewer bill and for <br />inquiring as to the disposition of certain assets of the North Suburban Sanitary <br />Sewer District. <br />MSP (Neisen /Hodges) To adopt Ordinance #191 which provides that in all <br />subdivisions greater than five acres 10% of the area involved must be dedicated <br />to parks either by the dedication of the land or by a cash payment. <br />4 Ayes <br />4 Ayes <br />4 Ayes <br />4 Ayes <br />Attorney Meyers reported that he has had to refile the Brama - Babinski easement <br />due to a change in property descriptions. <br />MSP (Johnson /Hodges) To adjourn at 9:17 P.M. 4 Ayes <br />Respectfully Submitted, <br />Dennis S.,.'lla, <br />Clerk- Administrator <br />DSZ /mn <br />
