Therefore, notices were merely sent to those in <br />conformance with the language of our zoning ordinance. <br />Mr. Hurajt, 5256 Long Lake Road stated that he did not receive notice until <br />Saturday, May 20th, 1972. Clerk Zylia explained that notices were mailed on <br />Monday, May 15th, 1972. <br />Mr. Hurajt also wanted to know why the townhouse was on the corner of County <br />Road H2 and Long Lake Road. Mr. Harstad explained that this was the only area <br />to the West of the three townhouses that had sufficiently solid soil. <br />Mr. Severt, 5238 Long Lake Road wanted to know where the swimming pool would be. <br />Mr. Harstad said he would be willing to place it just about anyplace. <br />Mr. Sickler, 5250 , Long Lake Road asked if Mr. Harstad would have purchased <br />the property if he had known it would have to remain single family. Mr. Harstad <br />stated that it was purchased a number of years ago with the intention of <br />establishing a trailer court. <br />Mr. James Nerdahl, 7941 Edgewood asked if the development was contingent on a <br />sale of the property. Mr. Harstad stated he will build and sell the townhouses. <br />Mr. Williams, 5145 Eastwood wanted to know what provisions were in the Homeowners <br />Association Agreement. Attorney Meyers stated that the conditions would become <br />a part of the special use permit. <br />Mr. Williams also asked whose responsibility the pond would be. Mr. Harstad <br />stated the Association would be responsible. <br />Mr. Perkins, 2559 Woodale stated that the townhouses would create traffic problems. <br />Mr. Harstad said there would be less traffic than if it were all single family <br />homes. No matter what was developed traffic was inevitable in that area he stated. <br />Mr. Christianson, 5273 Sunnyside Road also questioned notification of the hearing. <br />Mr. Kishel, 5244 Long Lake Road stated that the pond would contribute to mosquitoes <br />and traffic would filter onto Long Lake Road. Mr. Kishel also asked questions <br />on the common area in the townhouse development. Mr. Harstad explained that all <br />owners in the development including single family homeowners would pay a fee <br />to the Association. Mr. Harstad stated that between 40 and 50 single family <br />homes could lje built on the area where no townhouses are designated. He stated <br />that soil tests have shown that there is at least 15 feet of peat on the East <br />side of, the property where the ditch runs which would make it very expensive to <br />construct single family homes. <br />Mr. Seifer asked if Mr. Harstad was going to excavate all the trees on the <br />property. Mr. Harstad stated that he intends to leave the trees. Mr. Seifer <br />said he doesn't want to look at anything across the street except what is <br />there now. <br />Mr. Stone, 2609 Woodale asked if Mr. Harstad can build single family homes on <br />townhouse property. Mr. Harstad answered yes, the property was presently <br />zoned for single family. <br />Mr. Hurajt said the area looks good now as is and told Mr. Harstad that he had <br />made a bad investment. <br />
