-3- <br />Councilman Baumgartner's Report <br />Councilman Baumgartner acknowledged receipt of a letter from the Office of Local <br />Affairs which informed the Council that their grant application for park funds <br />through LAWCON would not be funded because of its low priority and lack of funds. <br />Councilman Pickar's Report <br />Councilman Pickar announced that the Lakeside Park skating area would be open <br />this Saturday. <br />Attorney Meyers' Report <br />Attorney Meyers reported that in the Sac Case the court had ordered all communities <br />to pay their escrowed connection charges. Mounds View has been paying and is <br />an involuntary defendent of the suit. <br />Attorney Meyers stated that he has spoken with Mr. Engelsma regarding the Minar <br />property park land appraisal and he is to meet with him in mid January. The <br />Programmed Land appraisal has been signed and will be ready shortly. <br />Attorney Meyers presented a memorandum regarding Lots 8 and 9, Spring Lake Park <br />Knolls Addition. He stated that the Council may rezone the subject property by <br />either initiating the rezoning and referring the matter to the Planning Commission <br />for their recommendation or the Planning Commission may initiate the rezoning and <br />report its findings to the Council. He noted that denial of a building permit on <br />the property would be reasonable if a comprehensive plan is authorized and underway <br />provided its conditions are defined clearly. He advised that factually supported <br />data would be imperative to support the rezoning. <br />Attorney Meyers stated that the question of damages to the owner of the property <br />should not be considered by the Council in considering whether or not to rezone. <br />MSP ( Neisen- Baumgartner) To authorize the Administrator to send Attorney Meyers' <br />memorandum to each Planning Commission member together with a letter asking whether <br />they want the Council to initiate a rezoning and refer the matter to the Planning <br />Commission for their recommendation or whether the Planning Commission should <br />initiate the rezoning and refer its report to the Council. 4 Ayes <br />Howard Thorsen, apparent owner of the property was in attendance. On December 17th, <br />he applied for a building permit to construct four 50 X 80 foot buildings on Lot <br />8 and the east half of Lot 9, Spring Lake Park Knolls Addition. The plans contained <br />no structural or mechanical drawings. <br />The Council was aware that Mr. Thorsen's representative appeared at the November <br />28th Planning Commission meeting and that the Planning Commission had reviewed <br />his site plan and had found it unacceptable. In addition, the Planning Commission <br />reported that they felt the zoning was spot zoning. <br />Mayor Neisen stated that since the Planning Commission has not yet approved the <br />plan, the Council could take no action affecting a building permit even if there <br />was not a zoning question involved. <br />
