-2- <br />The Council, fire chief, and Mr. Harstad agreed to a field test to ascertain <br />whether the system can generate 1500 gallons per minute. Mr. ,Harstad stated <br />that if the system does not generate 1500 gallons per minute, he would agree <br />to a water main extension. <br />MSP (Neisen- Johnson) To grant a special use permit to Keith Harstad in <br />accordance with Section 40.05 subdivision 2 (3) (g) of the municipal code in <br />conformance with the site plan dated November 12, 1973 and initialed by the <br />administrator subject to the following conditions: <br />1. That in one bedroom units both the upper and lower levels be <br />finished. <br />2. That there be constructed on the site a swimming pool and a tennis <br />court. <br />3. That there be no more than 33 percent one bedroom units. <br />4. That the plan be constructed in accordance with the approval of <br />the Rice Creek Watershed District, building inspector, and fire <br />chief. <br />5. That the bylaws and covenants of the association be presented to <br />the Council for approval. 5 Ayes <br />MSP (Neisen- Johnson) To issue a building permit for a six unit townhouse <br />building on the westerly edge of the site plan since there is general agreement <br />that at this location there is the required 1500 gallons per minute fire flow <br />capacity. <br />5 Ayes <br />MSP (Pickar- Johnson) To recess the Regular Meeting at 8:45 P.M. 5 Ayes <br />Mayor Neisen called the hearing on street improvement Project 1973 -6 to order <br />at 8:46 P.M. Administrator Zylla read the legal notice and attested to its <br />publication in the New Brighton Bulletin on January 24, 1974. Certified letters <br />were sent to Mr. Blair Wolfson, Mr. William Reimer, and Mr. Bill Edes, parties <br />affected by the improvement. <br />Mayor Neisen called for questions or objections from the floor. There were <br />none. <br />MSP (Johnson- Baumgartner) To order street improvement Project 1973 -6 and to <br />direct the engineer to prepare final plans and specifications. 5 Ayes <br />MSP (Hodges- Johnson) To adjourn the special hearing at 8:50 P.M. 5 Ayes <br />Administrator Zylla read a letter from Mr. Edes requesting a water main and a <br />storm drain extension into Programmed Land 1st Addition and agreeing to be <br />assessed 100% percent of the cost. <br />
