Park would also have a landscaped berm with trees. <br />Mr. Johnson felt that the City is interpreting "front yard" to mean the area <br />from the front of the building line to the property line and, that his <br />interpretation was that the "front yard" consisted of the area between the <br />property line and the building setback line. If his definition was correct, <br />then no variance for front yard parking would be necessary. <br />Mr. Johnson noted that the area between the blacktop terminal lot and the <br />mobile home park would be seeded. He added upon a question by the Administrator <br />that the front of the building could be redone at no increase in cost to make <br />it more esthetic and that Smith's Transfer would be willing to accept such a <br />stipulation in the special use permit agreement. Mr. Johnson said Smith <br />Transfer was willing to agree to all conditions specified at the February 11th <br />meeting. <br />Councilman Johnson was concerned about sleeping quarters on the second floor. <br />The architect assured the Council that these quarters were strictly for <br />Smith's Transfer drivers. <br />Councilman Pickar asked if there would be a curb within the property around <br />the parking area. Mr. Johnson stated that it would probably be a bituminous <br />curb or precast concrete. <br />The height of the berm was estimated at four to five feet. Mr. Johnson said that <br />there would be no vehicles stored in the seeded area on the property. The <br />Administrator suggested moving the gate to the seeded area over the City's <br />easement possibly avoiding obtaining a new easement to the west of this property <br />in order to gain access to the water tower. <br />Councilman Johnson noted that when the special use permit agreement is prepared <br />it may contain more or less terms and conditions specified in the Council <br />minutes of February 11, 1974. <br />MSP (Neisen - Pickar) To grant the special use permit to Smith's Transfer Corporation <br />to build a motor freight terminal on part of Lot 3, Mounds View Industrial Park, <br />contingent upon the preparation and signature of a written special use permit <br />agreement with an attached final site plan. 5 Ayes <br />MSP (Neisen- Hodges) To tentatively approve the site plan as presented on <br />February 25th, subject to its review and approval by the Planning Commission. 5 Ayes <br />Planning Commission Chairwoman Mrs. Haake informed the Council that when the <br />Planning Commission approved the special use permit for Smith Trucking their <br />only review was that of the sketch plan and their approval did not mean the <br />approval of the site plan.
