Page 10 <br />May 12, 1975 <br />Councilman Baumgartner thought the easement location should be spelled out more. <br />MSP (Johnson - Shelquist) to reconsider the previous motion. 5 Ayes <br />Mayor Johnson said a survey should be required showing accessory buildings and <br />other structures and physical features. <br />Councilman Baumgartner asked Engineer Bearden if NSP had acquired utility <br />easements in the area. Engineer Bearden stated NSP planned to come up be- <br />tween the back lot lines. <br />Council felt a survey should be obtained. <br />MSP (Shelquist- Baumgartner) to instruct the administrator to notify Mr. Bardwell <br />that prior to approval of his subdivision request a survey must be presented <br />showing existing and proposed structures and lot lines of adjacent lots for <br />the purpose of obtaining utility easements. 5 Ayes <br />Councilman Shelquist presented the Planning Commission's survey of garage <br />and accessory building sizes. The maximum recommendation under the State <br />uniform building code is 1,000 square feet. <br />Some cities have taken a position that the State code supercedes the city code, <br />while others claim their code supercedes State code. <br />Attorney Meyers said we have adopted by reference State code, but our zoning <br />code supercedes State code. <br />Councilman Baumgartner asked what alternatives the Planning Commission has <br />considered. <br />The Planning Commission feels the current garage size provides for adequate <br />storage space. The major question concerning members of the Commission is <br />what constitutes adequate storage and what invites buisness. <br />Mayor Johnson said this issue should be discussed at the next agenda meeting. <br />Councilman Baumgartner said the existing maximum garage size necessitates <br />accessory buildings which do not provide adequate security. <br />Councilman Shelquist inquired about the number of liquor licenses available <br />in Mounds View. Attorney Meyers said there is9naximum number of off -sale <br />liquor licenses. The state regulations limit our on -sale licenses to twelve. <br />However, he noted that the Attorney General has ruled that each municipality <br />has the right to limit the number of such licenses. Council does not have <br />to give a reason for refusing to license an applicant. <br />Councilman Hodges agreed that licenses should be limited according to popu- <br />lation and now is the time to do so. <br />Councilman Pickar said he doesn't know whether we have a problem with off- <br />
