-10- <br />June 9, 1975 <br />Mayor Johnson asked if he would go along with only platting half the plat. <br />Mr. Harstad said he would have to. <br />Motion (Hodges) to approve the existing plat just for building on Bona Road <br />side, Lots 9 through 16 stipulating no building be done on Edgewood side <br />until the road is put in and drainage problem taken care of. (Mayor Johnson <br />asked if this was platting all 16 lots.) Councilman Hodges said no building <br />on lots 1 through 8 until the street goes through and proper drainage system <br />is in. - <br />Motion died for lack of second. <br />Attorney Meyers said the problem is not with Mr. Harstad agreeing but <br />with his successors on the property. <br />MSP (Baumgartner - Pickar) to approve Greenfield Plat #3 including only Lots <br />9 through 16 (Lots 1 - 8 will not be part of the subdivision). Lots 9 thru <br />16 will now be called Lots 1 thru 8. These lots are on the west side of the <br />property bordering Bona Road. <br />Mr. Harstad felt Council would be better off approving the whole plat because <br />all the easements are provided for in the whole plat. <br />Councilman Baumgartner said Mr. Harstad would get a basement full of water if <br />we only get 1/2 of the easement. <br />Mayor Johnson asked about the size of easements on the north/south and <br />east /west line. Engineer Bearden suggested the east /west drainage ditch <br />carries a substantial amount of water, about four feet deep and one side should <br />be wider than the other for a place for equipment. <br />Motion continued that the east /west easement on Lot 4 be 10 feet wide and on <br />Lot 5 -30 feet; north /south easement 15 feet either side. Outlot A (Lots <br />1, 2, 3, & 4) and B (Lots 5, 6, 7, 8) no building permits will be issued on <br />these lots until the subdivision is approved. Mark exhibit A. Drainage <br />easement of 10' and 30' will also run to Outlots A & B. <br />Councilman Shelquist states he has reservations on developing anything until <br />the water problem, road, drainage system, swales are put in and this could <br />not be done until road is completed. <br />Mayor Johnson has reservations also. He understands Mr. Harstad's anxiety <br />about getting the lots developed but the City does not need any more problems <br />with people with water in basements. <br />Mr. Harstad said he has absolute legal right to this plat in fact this was the <br />purpose of having the hearing. <br />Attorney Meyers reflected he may have a point but what the court would say <br />in a case like this is not known. <br />Shelquist Naye <br />Pickax Aye <br />Baumgartner Aye <br />Hodges Aye <br />Johnson Naye <br />Attorney Meyers asked if Mr. Harstad owned at least 35% of the property on <br />r' wood. Mr. Harstad said yes, he owned about 50% and had already <br />petitioned for the road and it is still open. <br />
