-2- <br />July 28, 1975 <br />Mr. Glazer said that because of the minimal set back at the Shopping <br />Center without a buffering the R -1 property to the north would be <br />subject to rezoning. <br />Councilman Shelquist said this situation required a variance if not <br />corrected. He asked Administrator Achen to contact Mr. Paster about <br />the buffering. <br />Mr. Ole Bacon, 2625 Highway 10, asked if the City would give permission <br />for a produce truck to park on his property for the purpose of selling <br />corn and potatoes. He stated that in the past the truck parked on <br />the shopping center property and he has no objection to the truck parking <br />on his land which is located on the corner of Eastwood and Highway 10. <br />Administrator Achen reported that he has received calls from businessmen <br />in the area that were quite displeased with these produce trucks <br />competing with their business. <br />Mayor Johnson said he received a call from a person objecting to the <br />environment created around the truck. Namely the unsightly appearance <br />of the truck and congregation of children by the truck. <br />Councilman Baumgartner said the vendor should come to the city for a <br />permit and discuss the situation at that time. He is not in favor of <br />the unsightly vehicle such as the one parked on the shopping center <br />property last year. <br />Councilman Shelquist is opposed to the truck. He said last year <br />it was like a mini -flea market with people selling oriental rugs <br />and statues. If it is allowed to park and sell produce it should <br />be allowed to park only for the day and be taken away at night. <br />Mr. McCarthy, 7760 Long Lake Road, explained a problem he and two <br />of his neighbors have with surface water ponding in their backyards. <br />He said he has discussed this situation with the city administrator <br />and has decided that the most expedient way to correct the situation <br />was for them to dig a drainage ditch system to carry water to the <br />storm sewer easement on his property and wants to dictate how and when <br />it will be constructed. If he can't he said he will fill the ditch <br />in. Mr. McCarthy wanted to know the correct procedure to follow for <br />a situation such as this. <br />Attorney Meyers said that a petition could be presented to the city <br />with signatures of surrounding property owners asking for the improve- <br />ment. This would allow the city to assess the cost of the improvement <br />back to the property owners. <br />Mr. McCarthy said he has a letter from the contractor stating this <br />would be taken care of by May 1971. For this reason he would rather <br />do the work himself and charge the contractor for it. He said he <br />felt the city, particularly the building inspection department, should <br />see to it that contractors provide adequate drainage to homes they <br />construct. <br />
