Page 3 <br />October 27, 1975 <br />MSP (Shelquist- Johnson) to approve the subdivision request of Ernest <br />Danielson, 8445 Eastwood Drive creating three lots, two lots 85 X 264 <br />feet less a 30 foot road easement on Greenwood Drive and the third lot <br />264 X 235 feet less a 30 foot road easement on Greenwood Drive. <br />Attorney Meyers asked Mr. Danielson when the water main easement on <br />the north was granted. <br />Mr. Danielson said three or four years ago on the old improvement. <br />Attorney Meyes noted that when the deed comes into the office for <br />the clerk's signature the legal on this lot should reflect this ease- <br />ment. <br />Mayor Johnson presented proposed change order to Project 1973 -4 to <br />provide utility service for Jerry Ackerman minor subdivision, 8454 <br />Spring Lake Road. <br />Engineer Bearden explained the change order. It is for installing sanitary <br />sewer services and water services on 84th Avenue, N.E., between Pleasant <br />View Drive and Spring Lake Road. The cost is $6,830.15. He said the project <br />contractors are about ready to install the permanent street, so they need <br />to have this change order effected immediately. <br />Attorney Meyers advised that if Council wanted to proceed and put the <br />assessment in with one person being assessed, he did not know for sure <br />if the letter from Mr. Ackerman could be considered as a petition. He <br />said Council could proceed under MSA Chapter 429 and assess it later, <br />or the City could enter into an agreement with Mr. Ackerman but it must <br />be in advance of the improvement. <br />5 Ayes <br />MSP (Johnson- Hodges) to approve Change Order #3 to Project 1973 -4 to <br />extend utility services into the Jerry Ackerman subdivision at 8454 <br />Spring Lake Road and to the property immediately south thereof subject <br />to the receipt of an official petition from the property owner, Jerry Ackerman, <br />indicating that he desires the improvement and that he will agree to pay <br />the normal assessment cost for this improvement. <br />Attorney Meyers indicated that Mr. Ackerman could send the City a telegram <br />indicating such petition and acceptance of the assessment. <br />Mayor Johnson noted receipt of the proposed contract with Banister, Short, <br />Elliott, Hendrickson and Associates, Inc., to provide storm water drainage <br />engineering services. <br />Mr. Short, representing that firm, was present in the audience. Mayor <br />Johnson told Mr. Short the consensus of the Council at this time is that <br />they are in favor of going ahead with the study and the contract. <br />However, there are some words within the contract the Attorney would like <br />to have time to ponder and talk to Mr. Short about so that alternative <br />wording can be inserted in the contract. <br />
