-4- <br />2409 Sherwood Rd., and Phyllis Wheeler, 2649 Sherwood Rd., <br />inquired as to the date of completion, and Mr. Miller replied <br />possible in July. They both thought that it was a welcome <br />addition to the community. <br />Councilman Baumgartner asked if they were going to blacktop the <br />parking lot and if the fire department had checked it. Mr. <br />Miller stated, yes, it would be blacktopped and the fire <br />department will designate where they want their hydrant but <br />haven't determined exactly where yet. Councilman Baumgartner <br />inquired regarding parking, and Mr. Miller replied that the <br />PAK Co. will allow them to use their parking lot for certain <br />events. <br />Bud Teslow, 7932 Fairchild, asked where exactly it would be <br />located. Mr. Miller replied that it was the vacant lot <br />behind the PAK building on the east side. A group of investors <br />from Indiana own the house directly to the east of the PAK <br />Co. <br />Richard McFarland stated that all tennis courts seem to be <br />in the south, and it is tremendous that we will now have one <br />in the northern suburbs. <br />Mr. Miller, in reply to a question regarding their hours, said <br />that it will be what the people want. The indoor courts <br />could stay open 24 hours. <br />Councilman Baumgartner asked him if he had received a copy <br />of the city's fencing and screening ordinance? Mr. Miller <br />replied that he went over this quite thoroughly with the <br />Planning Commission and that the Commission granted them a <br />10 -foot fence with a 32 -foot variance. <br />Donald Borgen inquired as to why they decreased the side yard <br />setback to 24 feet, and Councilman Shelquist replied that we <br />have under consideration a new zoning ordinance and that this <br />would conform to that. <br />MSP ( Shelquist- Hodges) to grant the special use permit to Roland <br />Miller for construction of a tennis court per plans presented <br />and approved by the Planning Commission, subject to issuance <br />of a building permit and entering with the city in a development <br />contract setting forth the stipulations for construction of <br />the facility and posting of bond for performance, and authorizing <br />the administrator to negotiate a construction contract. <br />Mayor Johnson spoke in favor of the motion, from the standpoint <br />that he thought it would be a very good addition to the city <br />and explained that Mr. Miller could negotiate with the staff <br />the various points that the Council would want in the develop- <br />ment agreement. <br />Administrator Achen stated that the developer will have to <br />prepare detailed plans on what is discussed and go to the <br />Planning Commission for final approval and then back to the <br />Council, and at that time the contract can be executed. <br />
