July 12, 1976 Page 4 <br />Councilman Shelquist stated that he dislikes the situation but will <br />go along with it that way. He would like it referred back to the <br />administrator to negotiate with the Rosenquists to replat the land, <br />including Outlot A; in addition getting proper wording on the deed <br />that Outlot B would have the restriction in the title "abatement <br />of the assessment for two years or some reasonable time ". <br />Councilman Baumgartner stated that he agreed with Councilman Shelquist. <br />He would also suggest that Outlot B be made an outlot and hope that <br />he negotiates with the land owner. Have Outlot A as discussed before <br />and leave Outlot B as it is and not have it as being deferred as the <br />interest probably cannot be waived. <br />Acting Mayor Hodges stated that this should be referred. He agreed with <br />the lot splits, but something should be worked out for deferred <br />payments. <br />Atty Meyers stated that there are two issues here: deferred assessment <br />and whether you want to waive interest. <br />MSP (Shelquist - Baumgartner) that we `refer the subdivision back to the <br />administrator for negotiation of terms for a temporary abatement of <br />assessment and deferment of interest on Outlot B and for negotiating <br />of Outlot A into the Bonin property. <br />A roll call vote was requested: Councilman Pickar - aye <br />Councilman Shelquist - aye <br />Councilman Baumgartner - aye <br />Acting Mayor Hodges - aye 4 ayes <br />PUBLIC HEARING ON LEROY'S ADDITION <br />Acting Mayor Hodges called the Public Hearing on LeRoy's Addition <br />to order at 8:50 pm. The Planning Commission recommends approval of <br />LeRoy's Addition (applicant: LeRoy Johnson) with the requirement <br />that existing structure be removed from Lot 1 before approval of final <br />plat. The staff recommends accepting the Planning Commission's proposal. <br />The two new lots will be provided service from the front underground <br />utilities. <br />MSP (Baumgartner- Shelquist) to close the public hearing. 4 ayes <br />Councilman Pickar stated that he approved of it in concept the way <br />that he has it. We should run it through the engineer to determine <br />whether any easements are required. <br />Councilman Shelquist stated that he approved in concept subject to an <br />easement on the south lot line being determined necessary by the <br />engineer. <br />Councilman Baumgartner stated that the possibility of an easement along <br />the rear lot lines exists. <br />Acting Mayor Hodges stated that he concurs. <br />
