September 27, 1976 Page 15 <br />project. He suggested the words "at the developers request" be added <br />to Paragraph 1. Attorney Meyers stated when public improvements are talked <br />about throughout the contract it is the type of improvements authorized by <br />State Statute 429. He then reviewed this statute and stated that those <br />words could be added to the contract but they do not prevent the City from <br />putting improvements in through condemnation. <br />Mr. Benson stated that the improvements are already in the property. <br />Attorney Meyers stated that the words "proposed Phase One building site" <br />should be used rather than "development site ". Engineer Hubbard stated <br />that the developers will need to get another building permit, provide <br />additional parking spaces and may also need an addendum to the contract <br />for Phase Two. It depends on whether or not Phase Two comes into con- <br />formance with the City requirements. Also additional buildings will <br />increase the storm drainage. <br />Councilmember Baumgartner questioned the storm drainage once Phase Three <br />begins. Mr. Benson stated that this was mentioned to the Rice Creek Water <br />Shed District and it will probably be necessary at that time to increase <br />the area of the holding pond. <br />Attorney Meyers stated that Paragraph 20 would also have to be amended, but <br />he would have this document ready for signatures later in the week. Mr. <br />Benson asked if the words "no to exceed" could be inserted in item 32 about <br />expenses. Attorney Meyers stated that the Ordinance provides that all <br />administrative, engineering and legal fees be covered. Mayor Pickar <br />stated that on some development contracts in the past the Council set a <br />fee, but the costs have to be paid anyway. <br />MSP (Shelquist- Hodges) to take from the table the Bauer Welding & Metal <br />Fabricators, Inc., building permit. <br />Vote on the motion to adopt Resolution No. 768: <br />PROPOSED FOUR -WAY STOP AT COUNTY ROAD H -2 AND SILVER LAKE ROAD. <br />Mayor Pickar -stated the Ramsey County Engineer has s-reconmiended a four =way <br />stop at the intersection of County Road H -2 and Silver Lake Road. The <br />Director of Public Works and Police Chief have reviewed the accident and <br />traffic reports submitted by the County. The Police Department had a <br />petition for a four -way stop control at this intersection in 1974. The <br />Staff concurs with the recommendation of the Ramsey County Engineer. <br />MSP (Pickar- Hodges) that we direct the Staff to indicate our consent to <br />the installation of the four way stop at County Road H -2 and Silver Lake <br />Road. <br />SPECIFICATIONS FOR PURCHASE OF CITY SIGN AND READERBOARD. <br />5 ayes <br />5 ayes <br />5 ayes <br />Engineer Hubbard stated he would like to get approval of the plans and <br />specifications of the sign with some changes. He then reviewed the pro- <br />posed sign. Mr. Ziebarth, 5150 Bona Road, stated that after the base for <br />the sign was selected, the Council suggested that there also be a planter. <br />He stated that the base would not be used if there was going to be a planter. <br />
