PROCEEDINGS OF THE CITY COUNCIL <br />CITY OF MOUNDS VIEW <br />RAMSEY COUNTY, MINNESOTA <br />A regular meeting of the Mounds View City Council was called to order by Mayor <br />Pickar on October 25, 1976, at 8:00 p.m., at Mounds View City Hall, 2401 Highway <br />10, Mounds View, MN 55112. <br />Present: Mayor Pickar <br />Councilmember <br />Councilmember <br />Councilmember <br />Councilmember <br />Baumgartner <br />Rowley <br />Shelquist <br />Hodges <br />Also present: Clerk - Admin. Achen <br />Attorney Meyers <br />Engineer Hubbard <br />MSP ( Shelquist- Hodges) for approval of the October 12, 1976, council minutes <br />as presented. <br />Mayor Pickar corrected the spelling of Mr. Linke's name on Pages 5 and 6. <br />CITIZEN COMMENTS AND REQUESTS <br />Chris Franke, 7655 Woodlawn Drive, stated that they have a problem in their <br />apartments with the plumbing. The sewage has backed up and come out the tub <br />drain and onto the floor two times now. Both times on a weekend. She stated <br />that they have called the Police Department <br />the caretaker situation is irregular at the <br />able to help. She stated that she has also <br />he was out of town both times. Achen stated that the City would have problems with coming in to repair <br />this without the owners consent. The City would have the power to declare the <br />building a public health hazard and vacate it, but this would compound the <br />problem for the tenant rather than help them. <br />Atty. Meyers stated that the City is not allowed to go on private property and <br />alleviate a problem with City funds. There is recourse with the City Housing <br />Code, of which the owner may be in violation. Since there are many rights for <br />the tenant now, he suggested that Ms. Franke contact the legal aid department <br />of Ramsey County. <br />Ms. Franke stated that she should not have to hire an attorney just to find <br />out what her rights are as a tenant. Atty. Meyers explained that as a tenant <br />she has certain rights that aren't enforceable by the City; they must be privately <br />enforced. Atty. Meyers stated that since she talked to the City Housing Dept. <br />they are probably in the process of notifying the owner. <br />Mayor Pickar stated that we will be seeing an improvement in apartment houses <br />soon, because these things will be corrected through the new Housing Code program. <br />Mr. Block, 7655 Woodlawn Drive, stated that this building was condemned about <br />two years ago and was then rebuilt. Who is responsible for the inspection of a <br />building like this? <br />Mayor Pickar stated that the City Inspector would be. <br />5 ayes <br />
