October 25, 1976 Page 5 <br />Mrs. Chestek stated that all of the abutting people are not here tonight, and <br />she doesn't think they would all approve of this. Admin. Achen explained that <br />before the City can legally proceed there would have to be a MSA Chapter 429 <br />hearing when all of the people to be assessed would be notified with an estimated <br />cost of construction. Right now the Council just wants to know if the residents are <br />really interested in this. If they are the City will update the preliminary report <br />and get an estimated cost. <br />Mr. George Payne, 2740 Laport Drive, stated that the Planning Commission thought <br />it would be better to start now if there is going to be a Knollwood Drive extension. <br />This is why he started the petition. He stated that he doesn't care if the extension <br />goes through. When Laport Drive went in it only cost one -half as much as this. <br />He asked if the cost would be twice as much again if it went through in two or <br />three years. Mayor Pickar stated that this is possible. <br />Mr. Chestek questioned the reason for filling in some of the property. Engineer <br />Hubbard stated that this would be done to drain the water overland. The present <br />elevation isn't sufficient to have the water drain to existing facilities. The <br />fill needed ranges from 4 -1/2 feet to one inch. Admin. Achen stated that Comstock <br />& Davis felt there may be an option on the fill as to whether the City would provide <br />it or the property owners would. This would have to be evaluated to see which is <br />more practical. <br />Mrs. Chestek asked why there would be a road going out to Spring Lake Road. Eng. <br />Hubbard explained that the proposed extension of Knollwood would be quite long <br />without another access out. Not having the water main looped would cause pressure <br />problems and also double the maintenance. Admin. Achen stated that the road to <br />Spring Lake Road would allow homes to be developed along the east -west street as <br />well as the north -south street. <br />Mr. Payne asked if it has been considered to bring the road out to meet with <br />Groveland. Admin. Achen stated that it was proposed to go to Spring Lake Road <br />because there are houses on Groveland which would have to be taken out. <br />Mr. Donald Sohm, 8206 Groveland, stated that he gave an easement to the City about <br />a year ago when he subdivided his lot. He stated that he signed the petition. <br />Councilmember Baumgartner asked where the petition came from. Mr. Payne stated that <br />the Planning Commission suggested he see if the property owners wanted the extension. <br />Mayor Pickar stated that in order to bring this any further it would behoove the <br />people interested to get a petition of 35% or more of the property owners. <br />Atty. Meyers stated that the Council could commence the improvement without such <br />a petition themselves, but it would require a 4/5 vote. <br />Mrs. Chestek asked when the cost estimate would be made. Mayor Pickar stated <br />that this wouldn't be done until a petition is received and a public hearing is <br />held. If the Council wants to go further they would then ask the Engineer to <br />prepare a cost estimate. Councilmember Shelquist stated that the preliminary study <br />done in February of 1975 indicates that it would be $63.50 per front foot, which <br />would include storm sewer, sanitary sewer, water, curb and pavement. Councilmember <br />Rowley stated that it has probably gone up since then. At 9 :22 p.m. Mayor Pickar closed <br />the public hearing and called the regular council meeting back to order. <br />MSP ( Pickar- Baumgartner) to postpone any further study on the extension of Knollwood Dr. <br />until a petition is given to the City with the minimum of 35% of the names of abutting <br />property owners. 5 ayes <br />
