PROCEEDINGS OF THE CITY COUNCIL <br />CITY OF MOUNDS VIEW <br />RAMSEY COUNTY, MINNESOTA <br />A regular meeting of the Mounds View City Council was called to order by Mayor <br />Pickar on November 22,1976 at 8:00 p.m. at Mounds View City Hall, 2401 Highway 10, <br />Mounds View, MN 55112 <br />Members Present: Mayor Pickar <br />Councilmember Rowley <br />Councilmember Shelquist <br />Councilmember Baumgartner <br />Councilmember Hodges <br />Also present: Clerk - Admin. Achen <br />Attorney Meyers <br />Engineer Hubbard <br />MSP (Baumgartner - Shelquist) for approval of the November 8, 1976 minutes. <br />MSP (Shelquist- Hodges) for approval of the special council meeting minutes <br />of November 15, 1976. <br />CITIZENS COMMENTS AND REQUESTS <br />Rodney Robinson, 8340 Long Lake Road, asked that the Council waive the need for <br />a deed before getting a building permit. <br />5 ayes <br />5 ayes <br />Attorney Meyers explained that Mr. Robinson sold the west one -half of his property <br />to a contractor and is now going through a torrens proceeding. The contractor <br />wants to pull a building permit before the torrens proceedings are finished. <br />Attorney Meyers stated that waiving this requirement would be contrary to what <br />has been done in the past. <br />Mr. Robinson explained that on April 16th he turned over the abstract to his <br />Attorney to file for torrens. He then had a buyer so he applied to the Council <br />to split the property on October 25th. Mr. Robinson had the deeds typed up but <br />his attorney advised him that this would cause problems with the torrens pro- <br />ceedings. The property has been sold but there has not been a closing yet. <br />The developer has already sold the house with a closing date of January 31st. <br />The torrens hearing is set for December 15th but the contractor wants to get <br />started before the ground freezes. <br />Attorney Meyers stated that in the past the City has taken proposed deeds used <br />for conveyance of parcels and executed it along with the amount needed for filing <br />the deeds. This would guarantee that the parcel mould be conveyed. If this is a <br />torrens the City cannot file it and will not be able to until after December 15th <br />or longer. The proper procedure would be to have their attorney prepare proposed <br />deeds for the City, with a filing fee, and a letter stating that he will deliver <br />to the City a torrens certificate so the deed can be recorded. It should be <br />sufficient if the City has the executed deeds and the assurances of their attorney <br />that he will forward the torrens. <br />Councilmember Rowley stated that if Attorney Meyers feels he will have control of <br />this it would be acceptable to her. She explained that she did not want to see <br />two houses on one lot at a future date. Attorney Meyers stated that before the <br />building permit is issued the City will have the deed and the attorney's assurances. <br />
