November 22, 1976 Page 6 <br />Mayor Pickar stated the ordinance indicates that the maximum extension allowed <br />is 90 days. This doesn't mean that it can't be renewed. <br />Councilmember Hodges explained that the reason for the 90 day limit was because <br />the City had other trailers in the community out of a park and in case a problem <br />came up it could be handled sooner. He stated that vandalism is a problem and <br />did not see any problems with the mobile home staying until June 1. <br />Councilmember Rowley asked if the occupant would move off the property before <br />June 1 if the property is sold. Mr. Kelly stated that if the property is <br />sold they would ask reservation of the occupant's right to stay for his convenience. <br />Councilmember Rowley stated that the mobile home cannot have any other occupant <br />than the existing one. Mr. Kelly stated that the trailer will be moved from <br />the premises. <br />Councilmember Rowley stated she felt the 90 day permit should be granted at this <br />time but she would like to see the occupant move if the property is sold. <br />Councilmember Shelquist stated that as a practical, matter, if the Council grants <br />a 90 day permit now, they will also be granting the second 90 day extension <br />because the first one would expire in February when it may be unduly expensive <br />to move snow and pull the trailer out. He stated he felt there was a legitimate <br />hardship in this case because of vandalism and would favor granting two 90 day <br />permits, with the certainty that it will be removed before June 1. Councilmember <br />Shelquist stated he would like them to enter into a contract with the City that <br />guarantees the trailer will be removed so there is no doubt by any potential <br />buyer that the trailer will be removed. <br />Attorney Meyers stated that this could be simplified if Mr. Kelly would put it <br />into the form of a letter with the terms the City wants. Mr. Kelly stated that <br />he sent a letter of this type to Mr. Rose. <br />Admin. Achen stated the Council may get a request like this from the subsequent <br />owners. Mr. Kelly stated that the farm house probably would not be occupied <br />unless it was brought up to date. Councilmember Shelquist stated that the person <br />buying the property would either upgrade the house to liveable standards or remove <br />it. If it were to become a museum it would have provisions for a caretaker. <br />Councilmember Baumgartner agreed with the 90 day extension but felt that the <br />second permit would have to be granted after the first one expired. Attorney <br />Meyers stated it was not the intent of the ordinance to grant consecutive <br />permits, but it could be waived. <br />Mayor Pickar stated he would hesitate to do this. <br />Gordon Ziebarth, the newly elected councilman, stated he agreed with what <br />Councilman Shelquist had stated about granting one permit would also be granting <br />the second. He had no objections if the trailer is removed by June 1. Mr. <br />Ziebarth stated he would not like to change the ordinance or go against the <br />intent of the ordinance. The Council could issue a 90 day permit and give a <br />consensus on the next 90 day extension. <br />
