November 22, 1976 Page 9 <br />Councilmember Baumgartner pointed out that this report was not furnished by the <br />Metro Council, the City had to request it. Several communities did not know of <br />its existence until our Administrator made them aware. <br />Councilmember Baumgartner reviewed a portion of the report concerning the average <br />size and cost of the homes built in 1977 and stated that there is a market for <br />homes other than those of minimum requirements. The starter home is something <br />of the past. 5 ayes <br />ORDINANCE REGULATING CARNIVALS, CIRCUSES AND AMUSEMENT RIDES <br />Attorney Meyers recommended the follaing addition to the end of subdivision 3: <br />"A bond may be required in such form and amount as specified by the Council to <br />guarantee compliance with such conditions as may be herein imposed." <br />Mayor Pickar stated the City presently doesn't have an ordinance regulating this <br />type of activity. This item came about because of a request by the Bel -Rae <br />Ballroom to have its annual Polka Fest on June 16 -19, 1977. <br />Councilmember Shelquist stated that the license fee in the proposed ordinance <br />is $15 /day and if the Council denies the request there is a $25 forfeiture. <br />He pointed out that if the event was only for one day there would not be enough <br />money submitted to cover the costs. He suggested the fee be $25 for the first <br />day and $15 for every day after with a $25 forfeiture upon denial. <br />Mayor Pickar stated he did not think this would be out of line, since he could <br />foresee additional police activity with something like this. <br />Administrator Achen stated that Holiday Village Shopping Center has an annual <br />carnival and the City of Fridley charges them a flat $25 fee. <br />Councilmember Shelquist stated that this carnival is set off to one side of the <br />parking lot and probably doesn't generate much more additional traffic. <br />Councilmember Rowley stated she would go along with the suggested change in the <br />fee schedule. Councilmembers Hodges and Baumgartner agreed. <br />MS (Pickar- Hodges) to adopt Ordinance #257 with the amendment to Subdivision 3 <br />to add the bonding requirements as stated by the Attorney and to change the <br />license fee in Section 116.03 to $25 for the first day and $15 for every day <br />thereafter with a forfeiture of $25 upon denial. <br />Mr. Ziebarth stated that by listing different types of debris in Section 116.06, <br />Paragraph 3, it doesn't make room for anything else. He asked if driveways and <br />parking areas were also included in this section. <br />Administrator Achen stated this could be changed to, no debris at all shall be <br />allowed to be scattered about the premises, public or private property." <br />Councilmember Shelquist asked how the City could control a wind that would drive <br />the debris into a residential area. Something should be included to protect <br />private property too. Attorney Meyers suggested that the ordinance say that <br />"the operator shall not allow a public nuisance to exist ". Councilmember <br />Shelquist stated that requiring a bond could be used to get the operator to clean <br />it up. <br />
