December 13, 1976 Page 6 <br />want to give to the language in the petition. <br />Mr. Sward pointed out that there was not one signature on the petition <br />from any abutting home owners.The petition was signed by commercial <br />property owners and the apartment owners. <br />Mayor Pickar asked if the home owners had been talked to and an <br />agreement arrived at. Mr. Rothgeber stated that he talked to <br />Dick Mosman, who represented the home owners. <br />Dick Mosman, 7656 Greenfield, stated that he and Mr. Rothgeber did <br />talk but did not agree upon anything. He stated that this is not <br />the first time there has been a conflict in the application and pre- <br />sentation. The Council has made suggestions to the petitioners but <br />they keep coming back with the same thing. Mr. Mosman stated that <br />he did not intent to commit his neighbors in any way. He had said <br />that he would discuss any agreement he and Ir. Rothgeber reached iith <br />his neighbors but they didn't reach an agreement. Mr. Mosman <br />suggested that the Council reach some kind of a compromise since <br />the developers would not loose that much money by reducing the units <br />somewhat. The property abutting the single family homes could be <br />developed into homes too. <br />Mr. Rothgeber stated that the City spent many dollars for the <br />comprehensive plan which shows this area as a medium density zone, <br />which has been construed to be six unit buildings. <br />Mayor Pickar stated that he hoped something could be done that is in <br />agreement with the homeowners. The comprehensive plan does show that <br />area as medium density but the Council must also consider the health, <br />safety and welfare of the adjacent property owners. <br />Mr. Gustafson stated that the Planning Commission approved town- <br />houses over that whole area, not single family houses. Councilmember <br />Shelquist stated that this matter was before the Planning Commission <br />on November 10. Mayor Pickar stated that the Planning Commission <br />a; )-arov3d no cook of owner - occupied townhouses on Lots 4 -7, but <br />an R -3 zone does not require owner - occupied. There would have to be <br />a special use permit. <br />Joy In `;rowel stati that if the Planning Commission had seen plans <br />showing single family dwellings they probably would have approved <br />it. Councilmember Shelquist agreed. <br />Mr. Mosman stated that the comprehensive plan is not binding, it <br />is just suggestions that the council may want to take into consideration. <br />Mayor Pickar stated that it was more than this because it was adopted <br />by the City and it is the way the Council has decided to develop the <br />City. <br />
