January 24, 1977 Page 4 <br />Councilmember Baumgartner stated that this puts the Council in a <br />bad position of asking people to tear down an existing building. <br />Councilmember Baumgartner stated that he does think this will establish <br />a precedence if the request is approved. <br />Administrator Achen stated that the Council was concerned about how <br />large a building should be before you have to consider it as the <br />principal building. There has to be some type of restrictions to <br />discourage home occupations. <br />Mrs. Bonin stated that they didn't have any problems in getting <br />the variance on the original garage and she didn't think there <br />would be problems with this request either. They have 186 feet of <br />frontage with the two lots. <br />Engineer Hubbard stated that those lots may not always be that large. <br />Councilmember Rowley asked if the Bonins considered this as a temporary <br />building because they have plans to take it down someday. Mrs. Bonin <br />stated that they don't have plans to take it down, but it would only <br />require unbolting it. <br />Mayor Pickar stated that it is difficult for the Planning Commission <br />and Council to enforce the ordinances when a variance such as this <br />is granted. He stated he would be opposed to overturning the <br />Planning Commission decision, which was a six to zero vote. <br />Mrs. Bonin stated that the Planning Commission didn't feel they were in <br />a position to make that type of a decision. They felt the Council should <br />make it. Councilmember Hodges stated that the PlanningCommission makes <br />recommendations to the Council and if they were for this request they <br />would have said so. <br />Mrs. Bonin asked if they could split the lot and make this building the <br />principal building. AdministratorAchen stated that the zoning classifi- <br />cation is residential. The principal use of the land must comply with <br />the specific zoning classification. <br />Mrs. Bonin stated that they have two lots. Councilmember Baumgartner <br />stated that this was not an argument since the matter under discussion <br />is an oversized building. <br />Councilmember Rowley pointed out that the Bonin's still have the <br />option of an accessory building which can be 216 square feet. Part <br />of the metal building could be used for this. <br />MSP (Baumgartner - Hodges) to deny the variance request of Kenneth A. <br />Bonin, 8380 Pleasant View Drive, for the additional 14.5'x28' metal <br />building which is to he removed by May 1, 1977. <br />Councilmember Zieharth stated that the May 1st date may create a <br />hardship. <br />
