PROCEEDINGS OF THE CITY COUNCIL <br />CITY OF MOUNDS VIEW <br />RAMSEY COUNTY, MINNESOTA <br />A regular meeting of the Mounds View City Council was called <br />to order by Mayor Pickar at 7 :30 PM, March 14, 1977, at the <br />Mounds View City Hall, 2401 Highway 10, Mounds View, MN 55112. <br />Members Also <br />present: Mayor Pickar present: Clerk - Admin. Achen <br />Councilmember Ziebarth Engineer Hubbard <br />Councilmember Rowley Attorney Meyers <br />Councilmember Baumgartner <br />Councilmember Hodges <br />MSP (Hodges - Baumgartner) to approve the minutes of the February 28, <br />1977, regular meeting. 5 ayes <br />CITIZEN COMMENTS AND REQUESTS: Allen Zepper, 5255 Irondale Rd., <br />requested a Council INTERPRETATION OF THE CITY ORDINANCE REGULATING <br />FENCES AROUND SWIMMING POOLS. A citizen had approached Mr. Zepper <br />with the idea of erecting a 5 foot fence around his entire back <br />yard and connecting with the house and garage, thereby hoping to <br />satisfy the ordinance requiring a 5 foot fence around swimming <br />pools. Mr. Zepper stated the Building Official had taken the <br />position that this would not satisfy the code requirement and <br />that a fence directly around the pool would be required in addition <br />to the fence around the yard for safety purposes. <br />Councilmember Hodges stated that there are cases where the City <br />has allowed the one fence around the yard. However, there is the <br />safety factor to consider what if the owner leaves the garage <br />door open and while he's gone neighbor kids wander into the back <br />yard and into the pool? <br />Councilmember Ziebarth commented that the major thrust of the <br />ordinance is for safety purposes. The ordinance was designed to <br />provide as safe a pool as possible. He asked what accesses there are <br />to the pool in question? <br />Mr. Zepper indicated the accesses would be a patio door and <br />garage door -- only way to pool is through the house or through <br />the garage. <br />Councilmember Baumgartner stated that he feels the ordinance has <br />been satisfied with the fence around the perimeter, 5 feet tall. <br />The purpose is safety for children, but the City has done all it <br />can to satisfy the safety requirements. It is up to the homeowner <br />to have some sort of mechanism to lock the doors so that a child <br />cannot unlock it. Councilmember Rowley agreed, stating that the <br />City can go only so far in protecting the homeowner from himself. <br />The perimeter fence complies with the ordinance by keeping neighbor- <br />hood children out as long as it is securely locked. <br />Councilmembers Ziebarth and Hodges and Mayor Pickar agreed that <br />two fences is not necessary. Mayor Pickar stated that the City <br />has to follow the ordinance to the best ability, otherwise the <br />
