Mayor Pickar pointed out that the lots are within the square footage limits and the <br />City cannot dictate how a property owner should use his property. <br />Attorney Meyer stated that the Council must find an undue hardship to the property <br />owner in order to grant a variance. <br />Councilmember Rowley stated that she did not feel the issue presented an undue hard- <br />ship to Mr Harstad, and that she would like to have letters from NSP and Northwestern <br />Bell stating that they did intend to put in underground utilities. <br />Mr Harstad stated that he was applying for the variance on the two lots so that he <br />could develop 14 lots, rather than 13 larger lots, due to the economics of the <br />situation. He stated that the cost of the cul -de -sac could not be justified with <br />only 13 lots. <br />Councilmember Ziebarth questioned Lot #10, regarding the size and if it would need <br />a variance also. Administrator Achen explained that a staff error had been made <br />earlier in measuring the depth of Lot 10, and that it did fit the requirements. <br />Engineer Hubbard pointed out that the plat he was looking at did not seem to be <br />accurate in its scale versus indicated lot measurements. However, in checking <br />further, the lots appear to be bigger than what is indicated, rather than smaller. <br />Mr Harstad pointed out that the plat was a preliminary one and therefore was not <br />100% accurate and the surveyor normally draws the lots smaller on the preliminary <br />than they actually are. <br />Councilmember Hodges stated that he had looked at a development Mr Harstad had built <br />previously, on a cul -de -sac, and he felt the homes were very attractive and an asset <br />to the neighborhood. <br />Mr Harstad stated that the cul -de -sac was planned to come out on Groveland rather <br />than Fairchild because more trees could be saved that way. <br />Mayor Pickar closed the public hearing. <br />MSP (Hodges - Ziebarth) to approve request of Mr Harstad, 8400 Groveland, for a major <br />subdivision as presented on the April 14, 1977 plat allowing for variances on Lots <br />3 and 12, Lot 3 requiring a 5' variance and Lot 12 a 5' frontage variance; and that <br />Mr Harstad get in writing the agreement with NSP and Northwestern Bell that all <br />utilities will be underground. <br />A rollcall vote was taken: <br />Councilmember Rowley - nay <br />Councilmember Ziebarth - aye <br />Councilmember Hodges - aye <br />Mayor Pickar - aye <br />3 ayes <br />1 nay <br />Councilmember Rowley stated her nay was based on the fact that she felt there was no <br />undue hardship to the property and therefore no reason to grant any variances. <br />SUBDIVISION /PUBLIC IMPROVEMENT ALTERNATIVES - KNOLLWOOD PARK ADDITION <br />Administrator Achen reported that this item was placed on the agenda due to a previous <br />request from a citizen that he be allowed to subdivide his property in the area in <br />question. The Council denied his subdivision request at that time and recommended <br />polling the residents of the area to get their feelings on subdividing their property <br />and putting in further roadways, and to determine whether there is sufficient interest <br />for Council to pursue the matter further. <br />
