There is also an additional drainage easement of 10' on the <br />north lot line of lot 3 extending to the proposed new back lot line. <br />Mr. Smith reported that the Fishers have owned the land since 1941, and that what was <br />once rural land has now become residential, and due to the amount of assessments and <br />taxes Mr. Fisher has paid on the land, he now feels it is time to sell it. <br />Mayor Pickar asked if the problems discussed in the Planning Commission meeting had <br />been resolved, i.e., setback requirements. <br />Councilmember Baumgartner replied that when lot 5 was made into one big lot, the <br />variances originally asked for were no longer required. Also, the garage variance <br />would no longer be required. <br />Mr. Smith stated that the shed on the property would be removed, and that they are now <br />seeking approval of the revised plat, which consists of 9 lots, rather than the original <br />10 lots <br />Engineer Hubbard reported that Short, Elliot and Associates have some improvements <br />planned for the area. Administrator Achen replied that the City is asking for a 28' <br />easement and asked if there would be any problem with property damage. <br />Engineer Hubbard replied that they would be working within about 14' of the building <br />and will have to be careful. Mr. Smith pointed out that the original easement was for <br />10', which was now been expanded to 28'. <br />Councilmember Ziebarth asked what drainage district the property was in. Engineer <br />Hubbard replied that it was in SCP5, and that the water would eventually drain south <br />and go to the Scotland Green basin. <br />Councilmember Ziebarth expressed his concern that the water from the area would drain <br />onto the property of the people who already have water problems and recommended that <br />no development be approved until a decision was made on the drainage project. <br />MSP (Baumgartner - Pickar) to approve the preliminary plat of the Fisher Addition as <br />presented on the revised plat plan of 7/27/77 with the condition that if the garage <br />on lot 5 is less than 5' from the property line that it be moved, and the shed present- <br />ly on lot 6 be removed and that the lots facing Groveland that will require fill and so <br />forth before development, be required by the City to have soil tests and grading plans <br />prior to the issuance of building permits. 3 ayes <br />1 nay <br />Administrator Achen asked if there would be a single developer for the lots involved. <br />Mr. Smith replied that there would be one single developer. Administrator Achen then <br />recommended that the City enter into a development agreement on the Fisher addition. <br />MSP (Pickar - Baumgartner) to amend the previous motion and add that a development <br />agreement be drawn up on the Fisher Addition to conform with the file, the grading <br />plan, etc., as required by the City Engineer. <br />3 ayes <br />1 nay <br />Councilmember Ziebarth asked what the timetable was for development. Mr. Fisher <br />replied that they plan to start on four lots this Fall and that the remainder would <br />then be developed next year.
