January 9, 1978 Page 5 <br />DAILEY KNOLLS PRELIMINARY PLAT <br />Howard Thorson introduced himself as the representative of Dailey Knolls and stated <br />that they were requesting to subdivide the east one - halves of lots 8 and 9, Spring <br />Lake Park Knolls Addition, into three equal 88' frontage lots fronting on Silver Lake <br />Road. <br />Engineer Hubbard pointed out that the services were not in yet on Silver Lake Road <br />but they had been petitioned for. <br />• Administrator Achen pointed out that the land will be developed eventually and ser- <br />vices would be requested, and they would be extremely long ones if they came out to <br />Groveland. <br />Attorney Meyers pointed out that a public hearing had not been held yet to determine <br />what the people in the area really wanted. <br />George Payne, 2740 Laport Drive stated that he had put earnest money down on the <br />property at County Road I and Silver Lake Road and would be requesting services soon. <br />Attorney Meyers pointed out that 35 percent or more of the property owners would have <br />to petition for services before a public hearing would be held. <br />Mr. Thorson stated that he would find out who the rest of the property owners were <br />in the area and would contact them regarding a petition. <br />Mayor Pickar pointed out that in the past it has been the City's policy to deny lots <br />of substandard size, even though the lots in question had the necessary square footage <br />requirements. <br />Councilmember Ziebarth pointed out that lot number 4 was noted-as 36,712 square feet <br />while it actually should have been 26,712. <br />Administrator Achen recommended that if the Council approve the variance for the <br />frontage requirement that it not allow a variance for the sideyard setback. <br />Mr. Thorson stated that he could possibly acquire additional land from the adjacent <br />property owner to cut down on his 12' frontage shortage. <br />Mayor Pickar questioned if the whole matter would have to go back to the Planning <br />Commission if Mr. Thorson did acquire additional frontage. Attorney Meyers replied <br />that the other property owner would have to get approval tosplit off his property. <br />Administrator Achen stated that it could be handled as a consolidated effort and <br />costs could be minimized. He also recommended that the Council either table the <br />matter and allow the applicant and anyone else interested the opportunity to <br />discuss the issue as far as putting services down Silver Lake Road, or just set a <br />hearing and invite everyone in to discuss it. <br />MSP (Pickar - Rowley) to table any action and set an informational meeting for 9:00 PM <br />on February 13, 1978 and direct the City Administrator to notify the property <br />owners of the hearing. 4 ayes <br />Mayor Pickar closed the public hearing and reopened the general meeting. <br />
