January 23, 1978 Page 2 <br />Councilmember Ziebarth stated that several people had been calling the City Hall <br />complaining of the trucks and that if the City did not have an ordinance, it could <br />be buying trouble for itself. He also suggested that the truck drivers get together <br />and come up with a plan of housing the trucks as a group, which could cut their cost. <br />Councilmember Ziebarth also stated that he did not see how allowing trucks into the <br />City would be a workable solution. He also stated that he would be willing to meet <br />with a group to try and work out a solution. <br />Mayor Pickar recessed the general meeting and opened the public hearing for Seven - <br />Eleven. <br />SEVEN- ELEVEN GAS PUMPS - CONDITIONAL USE PERMIT <br />Dave Schaak introduced himself as Seven - Eleven's Minnesota real estate manager in <br />charge of development and gave a brief background of Seven - Eleven and what they <br />are requesting. He stated that Seven- Eleven presently has approximately 6500 stores <br />nation wide, of which approximately 1400 have self service stations, and stated that <br />they would like a conditional use permit to allow gas to be sold at the store at <br />County Road H -2 and Silver Lake Road. He also pointed out that by 1980 they are <br />predicting that 60 percent of all gas sold will be convenience. <br />Mr. Schaak stated that Seven - Eleven is a convenience store and that self- service <br />gas would be an added convenience, and that they would like one island with two pumps. <br />He also pointed out that they had received 77 signatures during a one week time <br />period of customers who said they would use the self service gas pumps if they were <br />offered, and that that list had been turned into the Planning Commission when the <br />issue was first discussed. <br />Mr. Schaak presented the Council with a booklet outlining what they intend to do <br />at the store, and asked that the Council approve their request for a conditional <br />use permit for self service gas. <br />Jerry Brill introduced himself as the counsel for Seven - Eleven and stated that the <br />Planning Commission had recommended to the Council to deny the request, based <br />primarily on two points: that it was imcompatible with the Comprehensive Plan <br />and that they considered it to be a traffic hazard. Parking in the rear was also <br />questioned since there was no rear entrance to the store. <br />Mr. Brill stated that neighborhood commercial is called for in the Comprehensive Plan, <br />while it is actually B -4, general business. He also stated that traffic studies <br />report the traffic to be 3700 cars per day on County Road H -2 and 6200 per day on <br />Silver Lake Road. <br />Mayor Pickar pointed out that the area was short the number of required parking <br />spaces. Mr. Schaak replied that they are required to provide 18 parking spaces <br />but that they do not believe all thatparking space will be needed. He also <br />stated that there was no rear entrance to the store as there is often only one <br />person working in the store, who could not watch two doors. <br />Mayor Pickar asked if they anticipate any stacking problem at the pumps. Mr. Schaak <br />replied that they don't since if it were full, the customer would generally just <br />drive on by to another facility or park and go into the store and make their purchase <br />without getting gas. <br />Mayor Pickar reminded Mr. Schaak that a sidewalk easement must be provided for. <br />
