January 23, 1978 Page 3 <br />Councilmember Ziebarth asked if they had experienced stacking problems in any other <br />areas. <br />Ronald Abiac introduced himself as the district manager for Seven - Eleven and replied <br />that the store at 105th and University Avenue is one of their highest volume stores <br />and that on the busiest days they have had only one or two cars waiting to get to <br />the pumps. He also stated that the lot at 105th and University is even smaller <br />than the one at H2 and Silver Lake Road and that they had not experienced any <br />problems. <br />Councilmember Baumgartner asked if it was located at an intersection. Mr. Abiac <br />replied that it was at a very busy intersection. <br />Attorney Meyers explained that the zoning map does not conform to the Comprehensive <br />Plan because the map has not been updated since adoption of the Plan and the new <br />zoning code in 1976. <br />Jessie Barnes, 7350 Silver Lake Road stated,that he was very much against the gas <br />pumps going in as he felt it would increase the traffic and noise considerably. <br />Less Mills, 7338 Silver Lake Road stated that he was also against the gas pumps <br />for the same reasons. <br />Norm Crosby, 7344 Silver Lake Road stated that he was also against the gas pumps <br />for the same reasons. <br />Don Schapass, 2824 County Road H2 stated that he was also against the gas pumps <br />for the same reasons. <br />Mr. Schaak replied that it was his feeling that traffic would not increase because <br />it is already there and that they would not be bringing traffic off of Highway 10 <br />since there were plenty of gas stations available on 10. He also stated that he <br />had discussed the traffic with a traffic engineer for Ramsey County, who did not <br />find any problems with the intersection since the four way stop signs had been <br />installed. <br />Mr. Barnes pointed out that several gas stations in the area have closed down in <br />the past few years and questioned the need for another. Mr. Schaak replied that <br />the major dealerships are getting out of the business, but that one stop service <br />for both gas and groceries was the future need. <br />Attorney Meyers pointed out that the property is zoned commercial and the Council <br />would be limited in what they could consider in granting a conditional use permit, <br />and that if the conditions they laid forth were met, the courts generally would <br />rule in favor of the request. <br />Mr. Barnes questioned if the present zoning would allow gas pumps. Attorney Meyers <br />replied that it is zoned commercial but that a conditional use permit would be <br />required. <br />Councilmember Ziebarth stated that he was concerned with the amount of turn - around <br />space between the parking stalls and the gas pumps since it was only 25 feet, <br />approximately. <br />Councilmember Baumgartner pointed out that in the Staff report, it was noted that <br />
